In 2016, the Commission performed a comparative law study on pre-trial detention, which highlighted a number of problems that arise from the diversity of pre-trial detention laws across Member States. The initiative aims to identify relevant aspects on pre-trial detention and detention conditions resulting from existing international standards, where more convergence between Member States would help to strengthen judicial cooperation in criminal matters.
