Response to Evaluation of the Measuring Instruments Directive

Elia Group, encompassing electricity TSOs Elia (Belgium) and 50Hertz (Germany), welcomes the Commissions proposal to evaluate the Measurement Instrument Directive (MID), recognising its strategic importance in supporting the EUs energy transition, digitalisation, and consumer empowerment objectives. We see the MID, next to speeding up the roll-out of smart meters, as a key enabler for unlocking flexibility, enhancing market participation, and ensuring accurate and trusted measurement across a rapidly evolving energy landscape. To fully realise its objectives, the MID should be further strengthened in a few key areas: ensuring synchronisation and timestamping of data, enabling granular measurement for flexibility services, expanding its scope to include other flexible devices like heat pumps and batteries, greater harmonisation across Member States. Response to Standards for wireless recharging, electric road system and vehicle-to grid-communication of recharging infrastructure

Certification of smart recharging standards: We welcome the focus to gradually let vehicles and charging infrastructure support the ISO15118-20:2022 standard (as pointed out amongst others in Annex II point 2.1.2), unlocking advanced smart recharging, and providing a standardized way to access a vehicles battery state of charge. However, the communication between charging point and charge point operator backend needs to be open and standardized as well, for smart charging capabilities to be unlocked at scale. This part of the communication chain is mostly covered by the OCPP 1.6/2.0.1/2.1 standard, which since a few months is recognized as an international standard under reference IEC63584 and can obtain independent certification of compliance via the Open Charge Alliance. We find it necessary to obtain those independent certificates of compliance for the standards to fully leverage on the benefits of the harmonization and interoperability. This is based on our observations that most charging stations and charging station management systems in the EU landscape didnt obtain OCPP certification, whereas the majority claims to be OCPP compliant. Cybersecurity: We find positive that recital (28) mentions that the application of NIS2 Directive and the requirements set out in AFIR should be complementary. This is important since operators of recharging points are considered as operators of essential services according to Annex I of NIS2 Directive, and that as such they need to take appropriate cybersecurity risk-management measures, including with regard to supply chain security (Art. 21(2)(d) of NIS2 Directive). However, recital (28) should also recognise the complementarity with respect to relevant sectoral legislation on cybersecurity, such as the Network Code on Cybersecurity (NCCS), which considers operators of recharging points as potential high-impact or critical-impact entities as mentioned in Article 2(1)(h) of NCCS. Additionally, the technical standards do not explicitly specify standards or practices with regard to cybersecurity, and we find relevant that this is mentioned or supported in this DA or upcoming evolutions. Communication with grid operators: With regard to Annex II, point 2 Technical specifications for communication exchange in the electricity recharging sector, currently only communication with distribution system operators is considered in 2.4 Technical specifications regarding communications between recharging point operator and the distribute system operators. However, there is data that will be of interest for transmission system operators (TSOs), possibly in an aggregated manner. Therefore, from our perspective, point 2.4 should be amended to include also transmission system operators in scope.

Concerning the implementation of Article 1(5), two alternative details are possible as 1st information: a) the quantity of gas already charged into the appliance by the manufacturer ("the quantity charged at the manufacturing site") or b) the quantity of gas for which the appliance is designed ("the quantity for which the equipment is designed"). From an asset owner's point of view, it should always be insisted that the total quantity is noted immediately by the manufacturer and option 1b is to be preferred. Furthermore, the regulation should apply to devices and systems ordered as of January 1, 2025, and not prior to that date.
