Response to Commission Regulation amending the CLP Regulation (EC) 1272/2008 and correcting Commission Regulation (EU) 2018/669

Acerinox is a stainless steel manufacturer in the EU located in Spain and we share the concern about the proposal of classification of cobalt with the rest of EUROFER members. Cobalt is not an intentionally added substance; it is present in stainless steels as an impurity. Stainless steel is an alloy (special mixture) and cobalt is embedded in the alloy or matrix, and therefore its availability is not the same as cobalt metal. The classification procedure is open, and the EU stainless steel manufacturers have communicated to their respective Member States that in their opinion, there are still some issues that can not be set without scientific evidences. Acerinox would like to ask not to include this proposal of classification for cobalt metal in this act, until a solid proposal can be prepared, without open issues like the carcinogenicity route and the assessment methodology. The potential classification of cobalt is already damaging the historical stainless steel reputation as a safe material for health and environmen. Stakeholders are concerned about the development and consequences of this procedure. Stainless steel needs a reliable cobalt classification, and we would like to request it through this public consultation.
