Response to Delegated Regulation on effective and secure access to On-Board Diagnostic and Repair and Maintenance Information

AFCAR the European alliance representing the wide ecosystem of multi-brand operators in the automotive aftermarket, including independent parts distributors, independent and authorized as well as specialized repairers, body repairers, independent data publishers and diagnostic tool manufacturers, mobility services providers and leasing & rental companies, roadside assistances and the motorist consumer organisation welcomes the opportunity to provide feedback to the European Commission on the revision of Annex X of Regulation (EU) 2018/858. AFCAR recognises the importance of this revision as a necessary step to align the type-approval framework with the rapid digitalisation of vehicles and the increasing reliance on software-driven functionalities. As vehicles evolve, so too must the regulatory foundation that ensures fair and competitive access to repair and maintenance services. At the same time, the proposal introduces significant structural changes for the aftermarket. Independent operators will face a higher degree of reliance on vehicle manufacturers than ever before. Access to multi-brand diagnostic tools a cornerstone of the independent aftermarket will increasingly depend on timely and comprehensive technical input from manufacturers, particularly in relation to cybersecurity integration, testing and validation. In addition, the uninterrupted operation of manufacturers servers, which enable authentication, parts coding and software updates, will become critical for day-to-day workshop activities. Any disruption or prolonged downtime could prevent independent operators from carrying out essential services. While AFCAR supports the Commissions overall approach, we believe that several elements require further clarification to ensure legal certainty, operational feasibility, and consistent enforcement across Member States. Our proposed amendments aim to strengthen the clarity and effectiveness of the Delegated Act and are set out in the attached document.
