Response to Review of the requirements for packaging and feasibility of measures to prevent packaging waste

As a manufacturer of forestry and gardening machines we support the replacement of the Packaging and Packaging Waste Directive by a regulation with binding rules in all MS (member states of the EU). Currently, more and more MS have enacted binding, country-specific and complex legislation (e.g. TRIMAN in France) for sorting information of packaging waste. These requirements can only be met by additional country-specific labelling of packaging with information on the sorting of packaging waste. The additional waste generated by more accurate disposal descriptions is not the ambition of the MS, but rather a legal necessity to comply with local laws. In one MS the laws are legally binding, in others they are even prohibited. Furthermore, the various regulations are extremely challenging from both a bureaucratic and a legal point of view. The aim should be to have not more regulations in the internal market than in the entire global comparison. The EU Commission should therefore introduce an information system for sorting packaging waste that is binding for all MS and easy to understand for the end consumer. Digital solutions such as QR code should be used to provide further information. No additional MS legislation should be required or allowed to inform customers about the sorting of packaging. Producers should be provided with a single packaging for the internal market as this avoids the waste generated by additional sorting labels explaining country-specific sorting rules for packaging waste. Regulatory action across countries would accelerate the reduction of bureaucracy and at the same time increase legal certainty through uniform rules throughout the single market.
