Response to Commission Implementing Regulation on the provision of voluntary indication of origin or place of provenance of foods

ANIA (Association nationale des industries alimentaires), representing the French food and drink sector, thanks the European Commission for the possibility to give feedback on the draft implementing Regulation on article 26(3) of Regulation (EU) N°1169/2011. We are fully in line with FoodDrinkEurope’ s position and supporting their input. We consider as crucial the implementation of harmonised provisions to ensure legal certainty to companies, which will also prevent any problems for trade within the Single Market. In addition, we would like to underline few major points: • A transitional period of at least two years is needed. The actual deadline set in 1st April 2019 isn’t feasible from an operative point of view. Then, this new implementing regulation adds to other national provision : in France, new origin labelling measures have been implemented at the national level in January 2017. It is very complex and nearly impossible for operators to change their labels every 6 months/1 year. • Regarding the presentation of the information, it should be possible to indicate the origin/provenance of the primary ingredient in the list of ingredient. As above-mentioned, existing additional national measures as in France require the origin to be given in/close to the ingredient’ list. It is important to avoid overlapping and inconsistencies with national legislation and allow a clear understanding of the information by the consumers. • It remains a number of interpretation issues that needs to be clarify before the measure’s implementation to avoid the risk that Member States will adopt divergent approaches : definition of primary ingredient, notion of place of provenance, clarity on the scope (e.g. legal, customary and generic names…), etc. We hope those elements could be useful in the next discussions that will take place at the European Commission level.
