Response to Single Market Strategy 2025

ACIBEV believes that the Single Market is the backbone of the European transition and competitiveness. Safeguarding its integrity and supporting its completion and enforcement are key to realising the full potential of the free movement of goods and maintaining the economic viability of the European industry. Only by cutting red tape, dismantling trade barriers and fostering monitoring, implementation and enforcement of the Single Market principles can Europe maintain its competitive edge. Preserving the functioning of the Single Market is also key to ensuring that wine and aromatised wine products can move freely across the EU to reach European consumers and businesses. From a holistic standpoint, harmonised rules are essential to improve the triple sustainability (economic environmental and social) of its value chain, ensuring that an EU-wide approach is not defeated by unilateral initiatives. The reflection on the future development of the European Internal Market as part of the upcoming Single Market Strategy enabling companies to scale up and compete globally is much welcomed and needed. Given the preparation of the Single Market Strategy, the following key recommendations are to be considered: The free movement of goods in the Single Market must be improved by full implementation and enforcement of the Single Market principles, supported by more harmonised rules, a strengthening of early warning systems such as the TRIS notification procedure, as well as timely and effective sanctioning of infringements of internal market rules and requirements. The adoption of any new EU legislative proposal needs to be accompanied by compliance with the Single Market principles and requirements and must be based on thorough impact assessments, competitiveness checks and the reduction of unnecessary administrative burdens. The Single Market principles need to be ensured across all Commission services, Council formations as well as the Parliaments Committees, to have an effective consultation of all relevant services in all phases of a legislative process.

Response to Restrictions on bisphenol A (BPA) and other bisphenols in food contact materials

ACIBEV welcomes the opportunity of providing the wine and aromatised wine products (AWP) industrys feedback regarding the ongoing consultation on the use of Bisphenol A (BPA) and other bisphenol substances launched by DG SANTE - Unit E.2 - Food Processing Technologies and Novel Foods on 9 February. ACIBEV supports the European Commissions goal to empower consumers to actively participate in the green transition by establishing a coherent policy framework to help making sustainable goods, services and business models the norm, transform consumption patterns in a more sustainable direction and help consumers to make better-informed choices about the products they buy. ACIBEV recognises the importance of providing a most appropriate harmonised framework by developing, on one hand, regulatory instruments that are compatible with international, EU and national standards, while, on the other hand, which also aimed to enabling its application in a practical way for the vitivinicultural sector and responding to the collective expertise work developed in that respect by our sector. It is of paramount importance to stress that any decision concerning the use of Bisphenol A (BPA) in Food Contact Materials, as well as other bisphenol substances, should be based on the latest and solid scientific evidence and consider the wine & aromatised wine products (AWP) sectors specificities in terms of production, management of vineyards and related equipments, including all actors and processes alongside our sustainable value chain. While we welcome the opportunity to provide contribution on this new initiative, some crucial elements need to be considered by the European Commission in its final assessment, as well as within its discussion with EU27 Member States representatives and final adoption of regulatory proposal.

Response to Indication of wine ingredients and adaptation of the rules for geographical indications in the wine sector

We welcome the opportunity to provide feedback on the recently released Commission Delegated Regulation amending Delegated Regulation (EU) 2019/33 as regards the presentation of compulsory particulars and specific rules for the indication and designation of ingredients for grapevine products. Considering the experience reached with the development of the U-label platform, specific rules are needed for the development of an adapted legal framework that considers wine and wine production processes adequately and consumer understanding. At first, considering that it is fundamental to have legal certainty and allow business operators to anticipate the application of the new labelling requirements for the mandatory communication of the list of ingredients for wines and aromatised wine products, ACIBEV strongly asks for the European Commission to adopt and publish the Delegated Act without delay. ACIBEV - Portuguese Wine and Spirits Association is a non-profit business association established in January 1975, which represents a significant part of the sector's turnover - production, distribution and trade of wines and spirits as well as vinegar and distillation of wine products. Its Associates have an annual turnover of more than sixty million euros, 60% of which are generated through export. Among our Associates are the majority of national export companies, leading companies in the various demarcated regions and companies that create brands that add value to Portuguese wines.

Response to Cross-border acquisitions of excise goods by private individuals

ACIBEV - Portuguese Wine and Spirits Association is a non-profit business association established in January 1975, which represents a significant part of the sector's turnover - production, distribution and trade of wines and spirits as well as vinegars and distillation of wine products. Please find attached ACIBEV feedback of the public consultation on cross border acquisition of excise goods by private individuals – revision of Art 32 of Directive 2008/118/EC based on the information presented by the European Commission in the inception impact assessment. ACIBEV is supportive of the status quo option with a better enforcement of current legislation without changes in the guide levels. Moreover, ACIBEV believes that the promotion of awareness campaigns could contribute to reduce the risk of fraud. ACIBEV believes in the importance of ensuring the good functioning of the single market in particular the free movement of goods principle and the principle of non-discrimination. In relation to health concerns ACIBEV believes that focus should be put of harmful use of alcohol and not on consumption per se. The vast majority of the population is consuming alcoholic beverages responsibly and in moderation.

Response to Farm to Fork Strategy

To fill the main gaps for a complete implementation of a successful Farm to Fork Strategy, it will be necessary to: a. Support research in the following fields:  Adaptation of the producing practices to ensure the maintenance of a sustainable production, its quality and, where appropriate, the terroir1 of the wines.  Improvement of plant protection and the reduction of the use of plant protection products to decrease environmental and social impacts  Knowledge and use of all the grapevine genetic resources thanks to conservation, exploitation and improvement of the genetic diversity between and within its varieties by focusing value generation while stopping genetic erosion. b. Better understand the efficiency and limitation of the information that would be shared with consumers. To implement successfully the future Farm to Fork Strategy, it would be necessary to work on: a. Assessment and promotion of sustainable production practices, including organic production, integrated viticulture.  All the knowledge that have been accumulated during the decades of wine production, as well as technics that has been developed by the research in viticulture regarding sustainability should be taken into account  Opportunity to introduce specific measures in order to facilitate wine producers access to new tools aiming to increase the environmental sustainability of production b. Develop new ways to provide information to consumers, including the use of digital tools.  Digital provision of information has the potential to communicate more efficiently and in a personalized way information to consumers but also reduce packaging waste and shipping costs. This approach should also ensure that all operators (micro, SME or large) are able to use and benefit from digital technologies. We seize this occasion to inform the European Commission that CEEV is working on the development of the digital platform for e-labels in order to provide consumers with accurate information in the most efficient way.  Principles for the communication of information through digital tools shall be stablished Finally, and as a base line for the efficient development and implementation of the Farm to Fork Strategy, the UE will need to: a. Strengthen of the coherence and governance coordination of all EU policies with potential impact on the food chain. b. Continued dialogue with all stakeholders to ensure the feasibility and adaptability of future measures. c. Secure the principle that policy recommendations at the EU level shall be strongly based on science

Response to Europe’s Beating Cancer Plan

ACIBEV welcomes the European Commission’s decision to involve non-state actors in the development of the EU Cancer Plan and wishes to reaffirm its strong commitment to support any action aimed at reducing harmful use of alcohol and promote balance lifestyles. ACIBEV – Portuguese Wine and Spirits Association – is a non-profit business association established in January 1975, which represents a significant part of the national alcoholic beverages business value - production, distribution and trade of wines and spirits as well as vinegars and distillation of wine products. While heavy or excessive consumption of alcohol beverages can have a harmful impact on health and is clearly associated with increased morbidity and mortality from some forms of cancer and other diseases, a moderate consumption of alcohol can indeed be part of a balanced and healthy lifestyle, such as the Mediterranean diet, and may have a number of positive and protective effects on health, including reducing the risk of cancers. Problems the initiative aims to tackle: Any action should be based on scientific evidence and be considered to achieve the given goals. ―Risk associated with excessive drinking •Excessive consumption of alcoholic beverages and binge drinking patterns are clearly associated with increased morbidity and mortality from several forms of cancer and other diseases. ―Moderate consumption of alcoholic beverages •Even a moderate consumption of alcoholic beverages can be associated with some cancers when considering alcohol in isolation. However, when wine consumption is considered as part of a healthy lifestyle (including regular physical exercise, a balanced diet, a normal weight, non-smoking), the risk is not increased and may even be decreased. •There is consistent scientific evidence of moderate consumption of alcoholic beverages decreasing the risk of cardiovascular disease, diabetes, osteoporosis and dementia. ―Healthy lifestyle and balanced diet, including a moderate consumption of wine, can have positive health effects •Adopting a healthy lifestyle and a balanced diet, such as the Mediterranean diet, has positive and protective effects on health, including reducing the risk of cancer. •A light to moderate consumption of wine can be part of such healthy lifestyle and balanced diet, without increasing the total cancer risk but rather decreasing it. •Drinking patterns are also important: it is best to drink wine in moderation, with meals, alternating with water and to avoid binge drinking. The initiative should focus on the following objectives: 1.Prevent and further reduce abusive and harmful consumption of alcoholic beverages 2.Promote a healthy lifestyle and a balanced diet, which can include a moderate consumption of wine To reach these aims, the following ideas should be taken into consideration: •Promote educational initiatives on responsible drinking patterns such as the Wine in Moderation programme •Implement communication and information campaigns at local, national and multinational level on the importance of a healthy lifestyle and a balanced diet, which can include moderate wine consumption •Promote truthful and science-based information to consumers, also by means of digital tools •Develop specific measures targeting groups at risk •Acknowledge that consumption taxes such as excise duties are inefficient in tackling alcohol abuse, as they do not distinguish between heavy/excessive and responsible drinking and therefore impact on all consumers including moderate ones, instead of targeting heavy drinkers. Consumption taxes can even have an adverse effect by increasing unrecorded alcohol and affecting those who consume moderately. Suggest a flexible set of actions, to be adjusted as needed by each Member State depending on their priorities and specificities, and involve the private sector in the implementation of these actions, to ensure the whole-of-society multi-stakeholders approach needed to fight cancer.
