Response to Commission Implementing Regulation -information provided for in Article 10 (10) of the RED 2014/53/EU

We are pleased to have the opportunity to comment the draft proposal for the EU commission implementing regulation specifying how to present the information provided for in Art.10(10) of Directive 214/53/EU. In particular we appreciate the definition of a timeline in Art.3 in order to give time to the manufacturers to modify their processes. However there are some issues concerning the application of RE-Directive 2014/53/EU Art.10(10) that require to be clarified. Time coordination on removal of R&TTED Alert Sign: From the Draft version of the Guideline to RE Directive 2014/53/EU Version of 31st October 2016, section 10.1.4 we understand the Class Identifier as “Alert Sign” should be removed when declaring the product as RED compliant latest by 13-Jun-2017: " Manufacturers should avoid the use of this sign when applying the RED so that in the course of time the sign disappears from the market." However we would appreciate a clarification that the removal of "Alert Sign" is not mandatory after the 13th June 2017, leaving highly preferable the option to make it mandatory at the same time of the application of Art.10(10). Article 3: Timeline We appreciate the definition of a timeline in Art.3 in order to give time to the manufacturers to modify their internal processes. However a timeline of 6 months after the Regulation entry into force is in general too short to implement these modifications: IT systems, material planning, including depletion of already stocked packages without the need of re-work, re-labeling or scrap. A minimum one year transition time would be more applicable. Annex I – Pictogram We suggest to consider the use of a standardized symbol (e.g. ISO 7000-1641) in order to make it simpler and more legible by the end-user. Annex II - Abbreviations To simplify the identification of radio equipment subject to restrictions on putting into service we also request to add EU, EFTA, EEA as approved abbreviations. Many manufacturers have products which require licensing in all EU/EFTA/EEA countries and therefore it will be much easier for customs/importer/distributors to identify restrictions for their particular country. General comment about implementation Taking into account the ongoing discussions within the EC and the EU Parliament on the missing harmonized standards (see also Question for written answer P-000666/2017 to the Commission) it should be highly preferable to align the transition timelines of the individual regulatory implementations to allow a practicable implementation of RED product compliance by test evidence, package printing, user information and DoC creation.
