Response to Proposal for a basic regulation of the European Chemicals Agency

Athena Cosmetics welcomes the aims of the Proposal for a basic regulation of the European Chemicals Agency (ECHA) to simplify and clarify the rules under which ECHA operates – in light of the additional tasks entrusted to ECHA and the upcoming implementation of other legislation under the Chemicals Strategy for Sustainability (CSS) – to ensure adequate safety assessments of chemical substances.
We note also the mention of the transference of tasks of the Scientific Committee on Consumer Safety to the Committee for Risk Assessment. We urge the Commission and ECHA to ensure that the rules of procedure for the SCCS are transferred along with the tasks, including the opportunity for stakeholder dialogue. This will provide the opportunity to ensure that the specificities of cosmetics and their regulation (EC 1223/2009) will remain in the scope of the work done by the Committee of Risk Assessment.
Concretely, Athena Cosmetics asks that the Commission, in its Proposal, ensures that:
• The role of ECHA for carrying out safety assessments of ingredients which are not toxic and do not affect the immune, neurological or respiratory systems, uses a risk-based approach to assessing the probability of a cosmetic or ingredient causing harm, considering dose and exposure. This will ensure adequate consumer safety and enable a competitive cosmetics industry.
• There is adequate consideration of data submitted by manufacturers and scientists and manufacturers of cosmetic products are given the opportunity and sufficient time in order to provide any additional ingredient or product-specific data requested to ensure evidence-based decision-making based on the most recent and relevant scientific data.
• Impacts on SMEs and any other economic, social and environmental impacts for the cosmetics industry from this Regulation are sufficiently taken into consideration in order to foster a competitive cosmetics market in which young companies are able to grow.
