Response to Review of the requirements for packaging and feasibility of measures to prevent packaging waste

Ball Beverage Packaging welcomes the European Commission's Packaging and Packaging Waste Regulation (PPWR) published on November 30th 2022 and recognizes the effort to help make Europe less dependent on primary resources and external suppliers and put the packaging sector on track for climate neutrality by 2050. In this position paper, Ball wants to highlight some remarks on the proposed legislation. 1. REUSE QUOTAS: Highly circular beverage packaging should be exempt from the calculation of reuse quotas if it is collected at least at 90% in a DRS in clearly separate waste streams and it achieves high mandatory recycled content rates (e.g. 80% recycled content) WHY: Obliging every producer, including SMEs, to switch to a potentially more environmentally damaging business model, is unproportional and might undermine (investments in) highly circular packaging collected in a DRS and achieving high recycled content within 3 years of implementing mandatory DRS across the EU. 2. DRS: a. Mandatory deposit return schemes (DRS) should include all materials for drinks containers. WHY: Limiting mandatory DRS to plastic beverage bottles and aluminium and metal beverage containers will create a discriminatory and disruptive economic and environmental impact on the market and potentially more single-use glass bottles in the EU with increased carbon emissions. b. At a minimum, a 90% separate collection for recycling target should be set by 2029 for beverage container packaging of all materials, regardless of whether collected in a DRS or in an EPR system, and DRS should be adopted in Member States whose collection performance fails to meet interim milestones needed to attain the 90% target. WHY: The 90% target will ensure that each country introduces a robust separate collection system focused not only on attaining the targets and reducing litter, but also at re-circulating the materials into closed loops, thereby preventing waste and supplanting virgin inputs with secondary recycled content several times over. c. Provisions for a variable deposit should be included and a retailer take-back obligation should be retained in the Minimum Requirements for DRS. WHY: Variable deposits prevent a producer and consumer shift to larger volume containers with unintended consequences. A retailer takes back obligation ensures that a large share of beverage containers put on the market in a Member State will be returned at or closely to the point of sale of beverages.
