The members of the Groep Graafrechten (Dutch Rights of Way Association) and NLconnect express their gratitude for the opportunity to respond to the Commissions proposal for a Gigabit Infrastructure Act. The Groep Graafrechten represents 12 providers of fixed electronic communications networks in consumer and business markets in the Netherlands and focuses on optimising the legal and regulatory preconditions for the efficient deployment and maintenance of electronic communications networks. NLconnect represents over 80 companies from the value chain of the Dutch fibre and broadband industry and shares this goal. We conclude that the GIA proposal in its present form does not create incentives for further investments in electronic communications networks in the Netherlands and lacks ambition with respect to national consistent administrative procedures for permit granting, costs of permits, repaving and degeneration costs. GIA OBJECTIVES SHOULD GO FURTHER THAN MERE CONNECTIVITY TARGETS In the Netherlands, various parties are active in the roll-out of FttH networks. As per April 2023, Gigabit coverage via cable and/or fibre in the country on the basis of DOCSIS 3.1 and FttH is calculated by the Ministry of Economic Affairs and Climate 98,5%. As a result, Gigabit for everyone - the connectivity target of the Digital Decade policy programme, is likely to be met by 2030. In order to stimulate further deployment, upgrading and lowering costs of maintenance of electronic communications networks, the policy objectives need to look further than mere stimulating network deployment and connectivity to the premise. In this context, the GIA lacks ambition and effective measures. Further detailed comments are in the attached document
