Response to Technical description of important and critical products with digital elements

Thank you for the possibility to provide feedback on this aspect of CRA implementation. The CRA is an extremely important legislation that will have a profound impact in the European market. Attached you will find some comments on the proposed definitions in an effort to ensure clarity and consistency with other provisions of CRA and current market/technological realities. Proposed additions to the definitions are marked in "red" and include justifications based on our understanding of the regulatory objectives. We would like to emphasize that the successful implementation of CRA will depend on the number of harmonized standards that will be available and on the speed that will be adopted so as to allow industry to smoothly transition from the current development practices to the CRA-mandated ones. Absence of those standards will create additional demand for conformity assessments which in turn will put significant strain on the response and service time of the conformity assessment bodies. For the products under class 2 and for the overall function of CRA the existence of an efficiently functioning conformity assessment market cannot be underestimated. The effectiveness of the conformity assessment process will hinge on the expertise available and the ability to clear conformity assessment in a reasonable timeline at an affordable cost. All this is possible, but requires a competitive market which in itself needs time to develop. In the absence of such market, measures such as international mutual recognition, adoption of commonly accepted international standards and self-assessment may be among the options to consider. CRA has the potential to transform the way products with digital elements are sold into the European market. We would like to commend the European Commission for the ambitious timeframe it is working towards with the aim of achieving timely implementation. We remain committed to a high level of security, resilience and data protection in the European market and look forward to provide additional feedback as the work on CRA continues.
