Response to EU Space Law: Union law for safe, secure and sustainable space activities

Bulgaria Sat welcomes the proposed EU regulation on the safety, resilience and sustainability of space activities in the Union. We recognise that the proposed act is a far-reaching and strategically important step in leveling the playing field in the EU, while positioning the Union as a global actor in space governance internationally. At the same time, from the point of view of the Bulgarian space industry, it is necessary to consider the fact that the proposed act provides for the main work on the implementation and verification of compliance with the requirements of the regulation to be carried out by a national authority. Meeting these requirements will require serious administrative and technical capacity in the national administration. In the absence of such capacity, there is a risk of delaying the implementation of the rules and possibilities of the proposed legislation, which will effectively block the possibility for national operators to be competitive in the common market, compared to countries that already have developed such administrative and technical capacities. Therefore, we call on the EU to carefully consider the administrative capacities across EU member states and to clearly assess whether each and every EU member state will be able to carry out their new obligations according to the requirements of the proposed regulation. In case some member states have troubles in enforcing the proposed regulations, this Space Act will not achieve its key intended purpose of leveling the playing field in Europe and setting the direction of efficient space governance internationally. In addition to the above, we enclose to this consultation (in tabular form) our opinion on specific issues addressed in the draft regulation. Bulgaria Sat is a privately owned company, which was established with the purpose of the construction, launch and operation of Bulgaria Sats own geostationary communication satellite covering Europe, Middle East and part of north Africa. Our satellite, Bulgariasat-1 is particularly well positioned to provide secured communications services to EU Member States and Ukraine. Bulgariasat-1, was manufactured by SSL/Maxar based on the SSL-1300-122 Omega II platform. It has 33 Ku band transponders, two beams European and Balkan and is in operation from the orbital position 1.9°E - a prime location for services to the target region. Bulgariasat-1 was launched by the Space-X Falcon 9 rocket on June 23rd 2017 from Cape Canaveral, FL, SLC-39A. In-Orbit Testing was completed a month later, when the satellite was handed over by SSL to Bulgaria Sat. With its 25 engineers and operators, 2 ground TC&R stations and the command center, Bulgaria Sat has achieved a flawless operational record of flying the satellite.
