Response to Digital Fairness Act

BESCOs position on the Digital Fairness Act (DFA) is that the new framework must remain proportionate, innovation-friendly, and supportive of startups and scaleups, which are key drivers of Europes digital economy. We urge the European Commission to avoid duplicating existing consumer protection laws and instead focus on better enforcement and harmonisation. The DFA should preserve all GDPR legal bases, including legitimate interest for digital advertising, and avoid over-regulating free trials, which are essential for small companies growth. A balanced approach will protect consumers while fostering innovation, competitiveness, and entrepreneurship across Europe.

BESCO identifies four critical areas for fostering Europes entrepreneurial ecosystem. First, Access to Capital: A Critical Factor for Growth, emphasizing incentives for angel and institutional investments, enhanced public funding for strategic sectors, incentives for corporate venture capital, and the establishment of specialized stock market segments for scaleups. Second, Access to Talent: Attracting and Retaining the Best Minds, advocating simplified visa and residency processes, improved employee equity frameworks, and streamlined intra-EU mobility procedures. Third, Regulatory Synchronization Across Member States, calling for a unified legal framework (28th Regime), harmonized fundraising regulations, and strengthened support for international IP protection. Lastly, BESCO highlights Recognizing the Strategic Importance of the SEE Region, urging targeted funding programs and enhanced research and technology transfer initiatives to leverage regional strengths and geopolitical significance in deep tech, cybersecurity, and energy innovation.
