Response to Review of the Broadband Cost Reduction Directive (Directive 2014/61/EU)

BREKO, the German Broadband Association, represents over 450 member companies that are responsible for the lion's share of fibre deployment in Germany. We welcome the opportunity to comment on the draft Gigabit Infrastructure Act. In our view, the proposed measures will not live up to the Commissions expectations to speed-up fibre deployment but will lead to significantly slowed down deployment, the strategic duplication of networks and an increase of the SMP operators market power, especially in the German market. The legal instrument of a regulation is neither proportionate nor adequate - a directive would allow for more leeway to implement measures.The proposed rules in Article 3 would lead to strategic overbuild of fibre networks, would slow down deployment and would lead to a weakened competition while increasing the incumbent's market power. Bitstream access has to be included in the viable alternatives (refusal of PIA). In Art. 5, a more precise definition of public sector bodies is necessary, while VHC networks should be excluded. The proposed transparency obligations reach too far and would risk the resilience of the networks. Especially the requirement to publish detailed information on planned civil works (Art. 6 para. 1) is very problematic. We generally welcome the proposed improvements of permit granting procedures and the decision to establish fibre networks as the new standard for in-building infrastructure.
