BUGLAS is grateful to the European Commission for the opportunity to provide our comments to the call for evidence on the Digital Networks Act. Please find our comments in the attached document. Below is a brief summary. Since 2009, BUGLAS (Bundesverband Glasfaseranschluss) has represented the interests of companies that construct and operate fibre optic networks (fibre to the building/home, FTTB/H) in Germany. The approximately 180 member companies of the association supply over 70% of all fibre optic customers (FTTB/H) in Germany. A revision of the legal framework must in any case lead to a significant reduction in regulation. In this respect, we welcome the EU Commission's announcement that it also intends to significantly reduce reporting obligations. BUGLAS considers it important that the EU Commission publishes the application report on the EECC as soon as possible so that the telecommunications industry has the opportunity to evaluate the Commission's assessment. Irrespective of this, BUGLAS believes that the EU Commission has in any case not taken into account all of the findings from this application report that are in favour of deregulation and reduction of bureaucratic hurdles in the legislative process. We are in favour of an EU regulation instead of a directive, as a regulation would not be able to solve the problems identified by the EU Commission. BUGLAS is also convinced that one size fits all regulations are not suitable in view of the market heterogeneity in the member states. BUGLAS advocates investment-promoting framework conditions for all companies expanding fibre optic networks. Regulation should therefore be limited to what is necessary and the principle of market before state should be emphasised. The ideal case with regard to sector-specific regulation is that it makes itself obsolete. The long-term goal of BUGLAS is therefore the application of general competition and antitrust law. BUGLAS rejects forced copper/glass migration. Firstly, there can be no general point in time for the nationwide availability of fibre optic products, as the prerequisites for this must be created locally, or at best regionally. Furthermore, BUGLAS sees no need for legislative intervention. BUGLAS considers the legal framework, which goes beyond the EECC, to be overly complex. New legislation must focus on reducing bureaucratic hurdles and strengthening competitiveness; in any case, no complexity or new obligations should be created. In this sense, there is also no need for a new objective of sustainability in the context of telecommunications regulation and no obligations relating to sustainability. Customer protection must have an appropriate level and scope. We do not consider the flooding of customers with information to be helpful.
