Response to Preventing and combating trafficking in human beings - review of EU rules

The Alliance Nordic Model includes over 45 associations, initiatives, numerous individuals from civil society and survivors of prostitution from Germany, Austria and Switzerland. Our alliance partners have many years of practical experience in working with prostitutes and outstanding expertise on the consequences of legalised prostitution in Germany. We welcome the revision of the anti-trafficking directive, but consider parts of the current version of the directive as insufficient to sustainably combat trafficking in human beings and sexual exploitation in the EU. The Commission's draft does not take into account the conditions under which trafficking in human beings and sexual exploitation take place. The draft overlooks the fact that the extent of human trafficking and sexual exploitation is significantly influenced by the existing national laws on prostitution. We want to elaborate on this point in the following because Germany and Austria are among the countries in the EU that have legalised the prostitution market and thus give enormous boost to human trafficking: In Germany, prostitution and profiting from the prostitution of others are legal. Since legalisation, the prostitution market has grown enormously. Human trafficking and also the knowing use of services for which people are exploited, as stated in the present draft of the Commission, are criminalised. The sexbuyer faces a prison sentence of up to five years for the careless misjudgment of the situation of the victim of human trafficking or the exploited person. Since the introduction of the law, there has only been one conviction of a sexbuyer. The law has no deterrent effect with such low conviction numbers and the almost impossible provability of the intention of the sexbuyer by the law enforcement authorities. This was also one conclusion of the evaluation the Ministry of Justice requested on the reform of the law. The fact that the laws against human trafficking are not effective is due to the legal framework of prostitution under which demand is legalised. The high demand for prostitution can only be met through trafficking and coercion. This means that a legalised prostitution market encourages demand, which in turn encourages trafficking for sexual exploitation. The Commission should therefore urgently consider making the demand for prostitution, which consequently promotes human trafficking, a criminal offence in principle. Against the background of the war in Ukraine, it has once again become clear that there is a targeted demand for the sexual exploitation of women. Here, online portals play a major role, through which grooming and the "advertising" of victims take place. The measures for the protection of victims and the prosecution of perpetrators must therefore also be applied to the digital space in the directive. Furthermore, the owners of such websites must be held accountable for the crimes that take place on their sites. The EU wants to combat sexual exploitation in all its forms. To do so, the Alliance Nordic Model recommends to tackle the root of the problem and criminalise the demand for prostitution in principle. This measure is the most effective instrument to prevent trafficking and exploitation.

Sehr geehrte Damen und Herren,
das Bündnis Nordisches Modell ist ein Bündnis von über 45 bundesweit zivilgesellschaftlich engagierten Vereinen, Netzwerken und Initiativen sowie zahlreichen aktiven Einzelpersonen in Deutschland.
Die geschlechtsspezifische Gewalt ist tief in den Strukturen, Normen, sozialen und kulturellen Werten des Prostitutionssystems verwurzelt. Sie ist wie auch in anderen gesellschaftlichen Bereichen sowohl Ursache als auch Folge ungleicher Machtverhältnisse. Im Fact Sheet Nr. 23 des UN-Hochkommissars für Menschenrechte werden als schädliche Praktiken all jene definiert, die zum Vorteil von Männern ausgeübt werden, die die Unterordnung der Frau unter den Mann in wirtschaftlicher und politischer Hinsicht zum Ziel hat und/oder die auf die Kontrolle der weiblichen Sexualität ausgelegt ist. Die 4. Internationale Konferenz zu Bevölkerung und Entwicklung 1994 in Kairo hat darüber hinaus festgehalten, dass schädliche Praktiken eine Verletzung der reproduktiven Rechte von Frauen darstellen, die negative Auswirkungen auf deren zu schützende Gesundheit haben. Die reproduktiven Rechte sowie die sexuelle Selbstbestimmung der Frau werden in und durch das System Prostitution massiv verletzt, wie wir im Folgenden noch ausführlicher darlegen werden. Jedoch gilt Prostitution in den meisten Gesellschaften als „natürlicher“ Bestandteil einer Gesellschaft und in manchen Ländern der Europäischen Uni-on, wie zum Beispiel Deutschland, sogar als eine legale „sexuelle Dienstleistung“ gemäß dem Gesetz zum Schutz von in der Prostitution tätigen Personen (Prostituiertenschutzgesetz - ProstSchG). Das System Prostitution hat sein Fundament in der Ungleichheit der Geschlechter, der Unterdrückung der Frau und eines angenommenen Rechts des Mannes, dauerhaft über den Zugang zu Frauenkörpern zur eigenen sexuellen Befriedigung verfügen zu können. Das System Prostitution schützt einzig und allein dieses angenommene „Recht“ des Mannes, aber niemals die reproduktiven Rechte von Frauen. Die kulturelle Verwurzlung des Systems Prostitution bzw. das dadurch vermittelten Geschlechterverhältnis wird offenbar, wenn der Blick auf die Nachfrage – die Freier – gelenkt wird.
Das Bündnis Nordisches Modell zeigt auf, dass Prostitution geschlechtsspezifische Gewalt ist und dass Menschenhandel zur sexuellen Ausbeutung, Zuhälterei und Nachfrage schädliche Praktiken an Frauen und Mädchen sind. Diese Praktiken sind bisher noch nicht in allen EU- Ländern strafbar. Insbesondere in Deutschland werden viele Frauen und Mädchen in die Prostitution gelockt, um sie dort sexuell auszubeuten. Das Bündnis Nordisches Modell hat konkrete Vorschläge für die EU-Partner und die EU-Richtlinie entwickelt, wie diese schädlichen Praktiken nachhaltig bekämpft werden können. Unser Bündnis hält es dringend für geboten, Menschenhandel zur sexuellen Ausbeutung, Zuhälterei und die Nachfrage nach sexuellen Handlungen, die Menschenhandel zum Zwecke der sexuellen Ausbeutung fördert, in die EU Richtline als schädliche Praktiken aufzunehmen.
