Response to Technical updates of the Emissions Trading Scheme (ETS) State aid guidelines

EU industries face double carbon costs under the EU ETSdirect emissions (partly offset by free allocation) and indirect costs via electricity prices. The voluntary, uneven ICC scheme works in an effective, simple and predictable manner in countries where it is applied. EU-wide, it creates competitive distortions, acts partly as a fossil subsidy, and complicates CBAM's design. Excluding indirect emissions from CBAM undermines climate integrity and EU competitiveness, since imports avoid full carbon pricing. The solution: reform ICC so it only compensates fossil-free electricity exposed to carbon costs, harmonise ICC across Member States, and include indirect emissions in CBAM by 2027 using plant-level data (not GoOs/RECs). This balances competitiveness, climate ambition, and fairnesswithout delaying CBAMs financial phase in 2026. Please read the Business for CBAM Coalition's position paper for more details.
