Response to Foreign Subsidies Review Report

BCI, CPP Investments, La Caisse, OMERS, OTPP and PSP welcome the opportunity to contribute to the European Commissions review of the Foreign Subsidies Regulation (FSR). We are Canadian pension funds and fund managers with long-standing investment activity in the European Union (EU), with approximately EUR 200 billion of collective assets under management in the wider European region and over EUR 1 trillion of collective assets under management as at the end of our last financial years. Our investments of long-term capital include strategically important sectors such as sustainable energy, infrastructure, transport, industrials and life sciences and directly contribute towards the EUs growth, competitiveness and security of supply. As pension funds and fund managers operating at arms length from government and investing solely on market terms for the benefit of their respective clients or beneficiaries, we support the FSRs overall objective of ensuring fair competition in the EUs internal market. However, we believe that certain aspects of the FSRs design and implementation materially and disproportionately affect investors like ourselves when considered against the harms which the FSR seeks to address. The enclosed submission provides the backdrop on the burden that the FSRs framework imposes and suggests various simplification measures which would lessen the burden that we are currently facing. It also contains suggestions to clarify certain key concepts of the FSR and how they are applied in order to increase legal certainty and predictability.
