Response to Digital Networks Act

Cellnex would like to thank the European Commission for the opportunity to contribute its views on the upcoming Digital Networks Act (DNA). As Europe´s largest telecommunications towers and infrastructures operator, with a pan-European footprint spanning across 10 countries, Cellnex actively contributes to meeting Europe´s infrastructure needs. Cellnex thus welcomes the ambition for the upcoming DNA to be an opportunity to strengthen the foundations of Europe´s digital future and to ensure its competitiveness in the global economy. A supportive investment climate conducive to both public and private funding along with continued legal certainty are key in meeting these objectives. Market outcomes show that the neutral host TowerCo sector is competitive and continues to drive long-term investment in wireless infrastructure, supported by a regulatory framework that has proven effective and fit for purpose. In this context, any changes to the access regulation framework should be carefully assessed, especially where they may affect segments of the market that are already competitive, investment-driven, and well-functioning. While access challenges may differ across the market, we believe the regulatory framework should continue to reflect the diverse range of business models within the sector some of which are already structured to provide open access without the need for additional regulatory intervention. Maintaining a flexible approach is therefore essential one that avoids unnecessary uniformity and allows policy responses to be adapted to specific circumstances where needed. The reforms introduced through the European Electronic Communications Code (EECC) have already delivered significant improvements to the regulatory framework, offering greater flexibility and a stronger focus on investment. We believe this flexibility remains an essential feature of the regulatory environment and should be preserved in any future framework to ensure that regulation remains proportionate, responsive to market realities, and supportive of both investment and long-term competitive outcomes. Close engagement with all relevant stakeholders will be key to ensure that future proposals are well-calibrated, clearly understood, and consistently applied across Member States. In addition, our full contribution (attached) suggests unlocking the EECC full potential to the benefit of small cell deployment, and highlights the important role of Digital Terrestrial Television networks as a key part of the European digital infrastructure. To conclude, Cellnex fully aligns with the Commission´s vision for the DNA to serve as a timely and substantial step toward innovation and Europe´s digital infrastructure rollout. In this spirit, we believe the DNA should prioritise key objectives that mirror the overall ambition for simplification, by preserving elements of the framework that underpin efficient and competitive markets and concentrating efforts on removing genuine deployment bottlenecks. This approach will pave the way for long-term certainty, by encouraging new investments while also safeguarding and enhancing the value of investments already made in Europe´s digital infrastructure.
