Response to Instrument to deter and counteract coercive actions by third countries

We welcome the possibility to take part in the ongoing discussions and to comment on the idea of an instrument to deter and counteract coercive actions by third countries (thereafter referred as Deterring Instrument). Summary of the position: • The EU should act on the international scene in accordance with the Treaty on European Union, which underlines the role of the EU in building cooperation in the world, solutions driven approach and promoting free trade. • Any consideration for establishing Deterring Instrument should take into account impact on efforts to build international environment based on consensus and to develop relations with third countries that share EU values. Such an approach should be prevailing over measures that could contribute to deepening divisions in the global economy. • The main EU focus should be on enforcing WTO rules in order to restore a fully-functioning dispute settlement mechanism with a renewed Appellate Body. • Given planned actions under Commission’s Communication “The European economic and financial system: fostering openness, strength and resilience”, doubling similar initiatives might not bring the necessary coherence and efficiency in protecting interests of the EU and its member states and might lead to a suboptimal allocation of resources. • Since Deterring Instrument aims at protecting “economic and geopolitical interests of the EU and its members” basing it merely on trade policy and Article 207 TFEU would miss the geopolitical perspective that requires always to be taken into account in such cases. • Adopting EU countermeasures through either implementing or delegated acts would miss complicated nature of coercive practices of third countries. Without properly established process including a consent of Member States, enacting of trade, investment or other policy countermeasures might lead to more harm than gains. • Criteria for adopting EU countermeasures under Deterring Instrument would require to be objective and reflecting finely nuanced circumstances of international relations. Only actions that are in line with EU policy and that do not undermine the principle of solidarity could be protected by EU countermeasures. For these reasons, there would be a need for a thorough assessment.

Response to Revision of the Renewable Energy Directive (EU) 2018/2001

Central Europe Energy Partners (CEEP), an organisation representing the interests of the energy companies from Central Europe, welcomes the possibility to provide feedback to the Commission’s Inception Impact Assessment on the revision of the RED II. CEEP believes that cost-effective decarbonisation is essential to guarantee that Europe achieves a strong position in renewables and that it remains competitive in the global market. However, an effective transition requires balance between the needs of the industry and the society. To make the energy transition a European success, the constraints of Member States have to be reflected in the new legislative framework of the EU. Please find attached CEEP policy recommendations which could facilitate an effective deployment of RES to meet the EU long-term climate and energy commitments.

Response to Offshore renewable energy strategy

Central Europe Energy Partners (CEEP) acknowledges a great potential of offshore renewable energy, particularly offshore wind, which can become an important element of the future EU energy system. This is why, we welcome the Commission’s initiative to draft the Offshore Renewable Energy Strategy. The deployment of RES onshore and offshore in Central and Eastern Europe (in Baltic, Black and Adriatic seas) would constitute a cornerstone of a swift transition towards a climate-neutral European economy. This strategy will play a vital role in supporting companies and Member States in their efforts to reshape their energy mix with an increased share of RES and other low emission sources. CEEP believes that an appropriate fine-tuning of the EU action in this sector will allow for both private and public entities to better prepare for the upcoming increase in utilisation of various low-emission energy sources and the energy sectors integration. Central Europe Energy Partners Urges Keeping Gas in Infrastructure Funding

Message — CEEP advocates for keeping gas infrastructure eligible for funding as a backup for renewable energy. They also propose lowering the project size threshold to allow local distributors to participate.12
Why — This allows members to modernize gas assets and access funding for smaller distribution projects.34
Impact — Major transmission system operators would lose their privileged access to funding compared to smaller distributors.5

CEEP urges flexible, technology-neutral approach to energy sector integration

8 Jun 2020
Message — The group requests a flexible strategy respecting different national starting points. They advocate for carbon capture and all forms of hydrogen production. Massive infrastructure investments in electricity and gas networks are also required.12
Why — This protects members' regional interests by allowing the continued use of gas infrastructure.34
Impact — Climate activists lose as the proposal extends the use of non-renewable gaseous fuels.5

Central Europe Energy Partners (CEEP) strongly believes that the transformation towards an innovative and low emitting economy should proceed in sustainable and balanced way. We welcome the proposal for a regulation establishing the framework for achieving climate neutrality by 2050 – the European Climate Law – but we think it needs further improvements and would like to submit the following comments.

Response to EU rules on industrial emissions - revision

Central Europe Energy Partner (CEEP) would like to present its comments to the Inception Impact assessment for the revision of the Industrial Emissions Directive (IED). We believe that achieving climate neutrality should be made in a gradual and coherent manner without overlapping policies and tools but also should set a clear pathway for industry in the regulatory framework. Response to Carbon Border Adjustment Mechanism

CEEP is in principle in favour of Carbon Border Adjustment Mechanism which shall create the level playing field for European and non-European producers. Taking into account the increased climate ambitions announced in the European Green Deal but also the process of recovery of the European economies following the COVID-19 outbreak, the equal treatment of EU and non-EU companies is of utmost importance for maintaining the production and proper functioning of European economy. Response to Climate Law

Central Europe Energy Partners (CEEP), supports a fair and balanced transition to a neutral carbon economy which takes into account different starting points and local specificity. Having acknowledged the European Commission will propose the ‘Climate Law’, which will enshrine the climate neutrality objective by 2050 in legislation, it is of crucial importance to define what climate neutrality exactly means as this definition would have significant effects on the business and investment decisions in the next decades. CEEP urges lower thresholds for trans-European energy infrastructure funding

Message — The organization calls for lowering the 500 MW cross-border capacity threshold to support smaller projects. They want to enable financing for network development needed for renewable integration regardless of cross-border relevance. They also suggest allowing large projects to be divided into separate smaller funding phases.123
Why — Lowering thresholds would allow regional distributors and smaller renewable projects to access funding.45
Impact — Large transmission operators would lose their current advantage in securing infrastructure financing.6

Message — The group wants the EU to apply its energy rules to all gas import pipelines immediately. They request clear definitions of EU jurisdiction and a transparent process for granting exemptions.12
Why — This would create a fairer market for Central European companies by preventing monopolies from controlling supply networks.34
Impact — Non-EU gas suppliers would lose the ability to dominate markets by owning both gas and pipelines.5
