CIP Portugal urges suspension of industrial emissions rules revision

A CIP - Confederação Empresarial de Portugal- agradece desde já a possibilidade de comentar o Roteiro para a Lei Europeia do Clima. A indústria portuguesa está empenhada em contribuir para alcançar os objectivos climáticos e energéticos da UE. Desde logo, consideramos que o principal instrumento para tal é o sistema do Comércio Europeu de Licenças de Emissão (CELE). Por outro lado, as empresas precisam de segurança e previsibilidade suficiente para decidir investimentos e se manterem competitivas, especialmente quando são introduzidos novos instrumentos ou os existentes são revistos. Acontece que a Directiva CELE foi recentemente revista para o período 2021–2030, e acreditamos que deve ser mantida inalterada por razões de segurança jurídica. Em particular, as medidas de mitigação do risco de fuga de carbono, cruciais para os sectores que se considera terem um risco significativo, devem permanecer estáveis durante toda a fase IV do CELE. Eventuais novas medidas, como o Mecanismo de Ajustamento Fronteiriço (CBA - carbon border adjustment) podem ser analisadas para os sectores interessados, porém, a sua implementação não deve ser considerada uma alternativa, mas sim um complemento às medidas carbon leakage actuais. Em qualquer dos casos, devem ser garantidas condições de concorrência equitativas no mercado Europeu e nos mercados não UE, destinos das exportações das empresas da UE. A luta contra as alterações climáticas deve ser alinhada em áreas-chave como a política industrial, financeira, política comercial e investigação & inovação, garantindo ao mesmo tempo justiça social para uma transição justa. O investimento em investigação, desenvolvimento e inovação precisa ser acelerado, em particular para fornecer soluções tecnológicas realistas. As mudanças necessárias na indústria para alcançar maior redução das suas emissões implica investimentos financeiros intensivos no processo de produção, bem como investigação e desenvolvimento com elevado custo. Por isso mesmo, estes sectores precisam de um quadro político estável, previsível e de longo prazo. A Lei do Clima deverá incentivar acções adicionais em outros sectores além dos sectores CELE para reduzir o consumo de energia e água, e as emissões (ex.: transportes e habitação). De salientar porém, que certas medidas como a possível inclusão do sector de transportes no CELE acarretará custos adicionais para todos os sectores da indústria transformadora já cobertos pelo sistema. É importante não esquecer que a Lei Europeia do Clima deve estar incluída numa estratégia de sustentabilidade mais ampla para garantir crescimento sustentável e inclusivo, protecção ambiental e bem-estar social. Deverá ser garantida a coerência entre a Lei Europeia do Clima, parte integrante da estratégia Europeia definida pelo Pacto Ecológico Europeu, e os Objectivos de Desenvolvimento Sustentável (ODS) da ONU.

Response to A new Circular Economy Action Plan

CIP, the Portuguese Business Confederation, considers the transition to a more Circular Economy through the development of a new EU Action Plan is one of the crucial measures of the Green Deal. Since the industry invested in advance in terms of energy efficiency, with very significant results, measures to improve resource efficiency are currently the best way to contribute to the achievement of a sustainable and carbon neutral economy. We agree with the generality of the Roadmap but we would like to share some notes on the concerns of companies with these matters: - The contribution of European industry to reach a climate neutral continent cannot be dissociated from other equally important and intrinsically linked contributions such as consumer’s behaviour and a regulatory system that prevents premature obsolescence or, simply, consequences of the demand for cheaper materials and products that are mostly disposable or less durable. - When the EC says that “EU citizens are increasingly aware of the impacts of their lifestyle”, it must be stressed that this is not the case in many regions and is not the same in all generations or social classes; moreover, saying that “… and are willing to act”, can be a misinterpretation, a misbelieve, because in most cases they will be available only if it doesn’t mean to reduce their quality of life according to current standards, which includes being accessible and accessing the web 100% of the time, have a source of energy 100% of the time, do not take more time on public transport or any other form of transport to work, etc. - One of the main barriers / factors to consider for a more Circular Economy is in fact the lack of the necessary skills, namely in the areas of repair and reconditioning. It is essential that this problem is addressed simultaneously in the development of the new Industrial Strategy. - Regarding the “sustainable products policy”, it is essential not to go beyond sustainable in terms of minimum requirements for products already subject to other regulations and other requirements. Especially when is not foreseen an impact assessment to guarantee sustainability, i.e., the balance between economic viability and environmental added value. - It is essential to reinforce and make it effective the border inspection of products imported from third countries, in order to guarantee a level playing-field for European producers. - We agree with the importance of fighting false “green declarations” but there is a risk of introducing heavy and expensive certification systems. Once again, we consider an effective market inspection system to be very important. - When it comes to packaging requirements, it is always associated only with plastic. Over packaging also concerns other materials. - Finally, we consider it important to take advantage of this new Action Plan to eliminate bureaucratic aspects and persistent obstacles to the reuse of waste and / or by-products, and the harmonization of criteria between Member States to facilitate the existence of a true European market for secondary raw materials.
