Response to Revision of EU legislation on end-of-life vehicles

Concordia Employers Confederation is endorsing the position of the European Automobile Manufacturers’ Association (ACEA) to support the European Commission’s initiative to ensure a better consistency with the objectives of the Green Deal, including the Circular Economy Action Plan and the European Climate Law. Product Longevity: The approach selected by the EC to favour circularity, prioritises the reduction of waste and reuse of materials/articles before recycling. It has always been the automobile industry’s goal to design vehicles as long-time usable products, while ensuring they are reusable, reparable, and recyclable to the highest possible degree. Dismantling Information: At some considerable cost and effort with the International IDIS -developed in close cooperation with the economic partners- vehicle manufacturers provide detailed information to ATFs to ensure the environmental treatment of End-of-Life-Vehicles, safely and economically. ATF are welcome to use the same reference as any independent operator/workshop with regard to finding relevant information to dismantle or reuse parts. Repair, Re-use, Remanufacturing: Extending product Life: Increasing the longevity of vehicles is actively supported by producers through the comprehensive remanufacturing programmes, among others. These programmes exist for many of the mechanical and electronic components. Design for sustainability: The automobile industry is actively participating in the Circular Plastic Alliance and is currently supporting discussion on the untapped potential for recyclates in vehicles. Waste reduction, including eco-design of cars to facilitate re-use, repair, remanufacturing, and recycling is a key goal. Recycled content: On top of the Circular Economy Action Plan, the European Climate Law defines clear climate and CO2 targets for 2050, suggesting carbon reductions efforts from all sectors. With this in mind, car manufacturers measure environmental performance (e.g. carbon intensity) internally to determine the most appropriate material for use in specific parts and components. In some instances, the use of a recycled material instead of a more performant and lightweight virgin material can contradict this approach, resulting in higher carbon emissions over the whole vehicle lifecycle. We would therefore like to highlight that no one-size-fits-all solution can help to drive circularity and deliver on climate targets at the same time and that each vehicle, each component and each material has different performance requirement. Hazardous substances - The ELV process could further be approved by taking the learning from other legislative processes, for example by including a socio-economic evaluation as to not overly burden the automotive industry for little to no improvement to the environment or consumer. Taking note of the fact that the auto industry has managed to phase out these heavy metals in the vast majority of applications and that there are only very minor applications left where further substitution becomes increasingly burdensome, the frequency of the Annex II revision should be reduced. To provide better cohesion between the ELV Directive and the REACH Regulations, we recommend that Annex II of the ELV Directive is introduced as a sector specific RMO for the restriction of these heavy metals under REACH, which is the approach that has already been taken for similar sector specific legislation (e.g. RoHS). Better enforcement of the provisions designed to ensure that all ELV are collected. - It is critical to implement a consistent EU wide obligation for the last owner to provide a Certificate of Destruction (CoD) to complete the final de-registration of a vehicle and to link it to the cancelation of the car insurance fees In such a system, the last owner of a vehicle would not be able to cancel the fees of its car insurance without an appropriate document which indicates the transfer of the ownership or an appropriate CoD.
