Response to Data Act (including the review of the Directive 96/9/EC on the legal protection of databases)

Technological advances are leading to a transformation in users' practices, leading them to reconsider their expectations in terms of safety, respect for the environment, inter-modality of means of transport, but also, and above all, of services. Consequently, the downstream automotive sector, which is in direct contact with users, is at the heart of these transformations. However, the appearance of connected and soon to be autonomous vehicles on the mobility market has created new issues for the automotive aftermarket, mainly around access to and use of the data emitted by the vehicle. Mobilians calls for 8 major principles for a fair access to data: 1 - All data, whatever its nature and subject to user consent, must be accessible in an equitable manner to all stakeholders. 2 - The choices of vehicle users should be made truly effective by means of fluid and reversible arrangements for obtaining their consent. 3 - Several access modalities must be foreseen to preserve technological neutrality and avoid monopolistic situations. 4 - These accesses must take place under identical technical and economic conditions for all stakeholders, from the manufacturer to the independent operator. The financial conditions must be reasonable and compatible with the development of innovative services. 5 - Access to vehicle data and resources (including the man-machine interface) must be direct and in real time, i.e., without delay. 6 - Stakeholders must be able to access essential data contained at the ECU level in the context of a business need. 7 - A cross-sectoral and cooperative approach must make it possible to achieve a shared objective of vehicle safety and cyber security. 8 - European regulations are essential, particularly in terms of standards, to establish these principles and neutral governance.
