Response to Report on the application of the General Data Protection Regulation

Danske Medier (873181915791-38) is the trade association for all private media in Denmark and has worked extensively with the practical implementation of the GDPR in regards of protection of free journalism, online advertising and commercial media industry in general. While we appraise the sound principles of strong data protection, we still would like to take this opportunity to recommend the following issues to be addressed in the continued improvement of the European data protection legislation. Unfortunately, compliance with GDPR provisions require an unreasonable amount of resources from most companies that do business especially in the online industry. We therefore would like to suggest more harmonisation of rules and enforcement between member states and further clarification of concepts such as “freely given” consent, which should be considered in a balanced way with other important aspects. The right to privacy cannot be translated into a ‘right to free access’ to commercial goods such as online content provided by news media. A freely given consent must be allowed to be a choice between either accepting processing of unsensitive personal information for commercial and marketing purposes - or choosing not to access the content at all. Also, there is a need to recognize the strong benefits of processing personal data. It seems as if any use for commercial purposes are by default considered to be harmful for consumers by Data Protection Authorities. The fact is that the application of observed consumer behavior and preferences has led to massive innovation, service improvements, and economic growth. The Commission should emphasize this aspect to DPAs and require it to be an important part in considerations of GDPR-compliance. Finally, Danske Medier recommends that the Commission supports and enables industry legal compliance tools, e.g. IAB Europe’s Transparency & Consent Framework and other international Codes of Conduct, which will allow for the media industry to innovate and pursue all sort of digital business models without legal uncertainty. Online advertising is a substantial revenue source for the newspaper and magazine industry and supports the unhindered access to quality journalism for millions of European citizens every day. Also, the development of paid content requires the availability of processing of personal data.
