Response to EU Space Law: Union law for safe, secure and sustainable space activities

EBAN Space & Defense, https://www.eban.org/eban-space/ the European Business Angels Network trade association body for early stage investment and innovation in Space and Defense is honoured to provide some remarks for the EU Space Act Consultation. First, we would like to congratulate the European Commission on drafting this timely regulation to address the growing geopolitical, cyber, and physical risks to the European Unions space infrastructure and services. We are also very impressed by the efforts taken to make certain that the input and views of all public and private players in the Ecosystem are represented. Our EBAN Space and Defence Committee at EBAN is delighted to present a series of recommendations for the EU to consider. Please find our recommendations mentioned in the annexed file. Response to European Innovation Act

EBAN suggests focusing on: - creating the sandbox regulatory framework 28th regime as the means to harmonize the regulatory frameworks that are fragmented across Europe. - create incentives for pension funds and other instiutional investors to invest in VC funds from early to later stages. - go beyond pari-passu co-investment schemes to crowd in more private market players, specifically for funding of strategic innovations in their earliest stages. - provide recommendations to member states to create fiscal incentives for private investors to invest in startups - create public-private co-investment schemes targeting business angels that invest in startups developing strategic innovations (ex. defence, deeptech, quantum, etc)

Besides the 28th Regime initiative, the EU Commission could focus efforts also on: 1. creating incentives so that pension funds and insurance companies become investors in the European VC asset class (as LPs of VC funds). In the US, VC funds regularly fundraise from such entities. In Europe, only very few institutional LPs are investing in VC funds. The Commission could develop a guarantee scheme to crowd-in such institutional investors, reducing investment risks and integrating ROIs when needed. Yozma funds in Israel have worked in a similar manner to give guaranteed minimum returns to retail and institutional LP investors in VC Funds. 2. Earmark a part of the EU Commission research and innovation budget to be used by national development banks and promotional agencies in member states to develop public-private co-investment schemes with business angels. The benefits of such schemes have been proven already across multiple member states. The accelerate the development of angel investment ecosystems, promote syndicated investments, and play a strong crowd-in effect on private capital. Member states that want to develop national level co-investment schemes with business angels can use the EU budget earmarked for this purpose to finance those schemes.
