Response to Environmental, social and governance (ESG) ratings and sustainability risks in credit ratings

EcoVadis endorses the intent of the European Commissions proposal to regulate the activities of environmental, social and governance (ESG) ratings providers. We welcome the introduction of regulation to improve the credibility of the ESG ratings sector - beyond its value-add in the financial sector. We also see opportunities to improve the adaptability of the regulation for diverse ESG use cases that will allow the ESG rating market to continue growing and innovating. Response to European Sustainability Reporting Standards

EcoVadis supports the adoption of strong, comprehensive and high-level standards for a materiality analysis methodology in the ESRS. Materiality analysis is a critical exercise and a prerequisite in designing a robust, tailored and effective sustainability strategy. Using materiality analysis as grounds for disclosures opens the door for proportional and customized reporting requirements. If underpinned by a strong methodology, a materiality analysis will identify those topics relevant to a company's sustainability strategy and activities. Thus, applying a solid materiality analysis, topics that were subject to mandatory requirements in the previous ESRS draft should be categorized as relevant by all undertakings as they represent pressing challenges in todays world and implicate all companies, regardless of size and sector (e.g. climate change, diversity and equity). A robust materiality analysis would guarantee this. It is our belief that making those requirements mandatory would send the wrong signal to companies that they are expected to comply with requirements which are unnecessary and irrelevant to their sustainability impact. To make it clear that this is not the intent of the ESRS, we support the materiality approach preferred by the European Commission. In addition, mandatory requirements risk turning sustainability disclosure requirements into a mere tick-box exercise, whereby companies focus on compliance as opposed to business transformation. What follows is that we do not support the introduction of more optional data points, especially those related to biodiversity and non-directly employed workers. Materiality approach should be applied consistently across the board. If the materiality assessment identifies these topics as risk, then they should be reported on, and no trade-offs should be made. To ensure comprehensive and standardized disclosures on relevant issues, the ESRS must require that the methodology for materiality analyses fulfills high standards. A strong methodology for contextual materiality analyses will make sure that all companies are conducting their materiality analysis equally. It doesnt mean the results of the materiality analysis itself will be comparable but that the results are comparable across companies. An adapted framework can thus ensure that burden on companies is minimized while promoting high-quality business sustainability disclosures, which in turn should drive improved sustainability performance.
