Estonian Chemical Industry Association, which has members from more than 50 companies in Estonia, strongly advising Commission to carry out deep in-depth impact assessment while revising EU ETS directive. We are very concerned about the loss of competitiveness of EU Industry vis-a-vis third countries. Given the lack of commitment and action by global competitors to cut their emissions and take on climate action our industry is facing challenging times and exposure to economic risks inclines. It is imperative that while revising ETS directive these economic and social impacts are fairly and robustly addressed. Our main points for ETS revision are the following: 1) Having faced the reality in terms of competitiveness of EU Industry carbon leakage list shall be maintained as it is at the moment 2) Linear reduction factor (LRF) shall be reviewed for post 2030 period. Current LRF 4,3% and climate neutrality target for 2050 are not in line. LRF 4,3% will bring along much faster decarbonisation pathway to our industries, particularly for hard-to-abate sectors and energy intensive industries. This has very negative economic and social impacts for EU and relocating our industry to third countries. 3) ETS revision shall strengthen carbon leakage protection by ensuring robust protection to all exposed sectors from direct and indirect carbon costs. Exporting sectors will need particular attention in this regard. Therefore we see that allocation of free allowances shall be maintained in significant amount beyond 2030 and CBAM measure shall not be applied to extra EU exports. 4) Extension of sectors subject to CBAM can only be considered when there is hard evidence that CBAM in its current limited scope really delivering, it has global impact on GHG emission reduction and it has no negative impact to EU economy 5) When setting benchmarks for different sectors there is a strong call to assess the availability of technologies and their affordability in order to avoid setting benchmarks at the level which are not broadly achievable due to the scarcity of resources and lack of infrastructure. 6) The division of allowances between Industry and power sector (43%-57%) needs to be revised. Share of allocation for industry shall be increased due to the much lower rate of decarbonisation opportunities for industry due to the lack of technologies and unfair competition with industries in third countries. 7) Market stability reserve shall provide liquidity to the market and should be refocused. Industry needs allowances also beyond 2030 to keep economy going. Invalidation of allowances shall be stopped immediately.

Estonian Chemical Industry Association feedback on draft Commission Delegated Regulation for free allocation of allowances amending Delegated Regulation (EU) 2019/331 ECIA representing Estonian Chemical Industry with a focus on chemical safety and environmental protection with sustainable economy. We have more than 50 members. Estonian Chemical Industry Association (hereinafter ECIA) acknowledges the need for revision of and welcomes the opportunity to provide feedback on the Delegated Regulation (EU) 2019/331 as regards transitional Union-wide rules for harmonised free allocation of emission allowances. Our comment is related to the amendment (7) (b) (ii) of the draft Commission Delegated Regulation which amends article 16 paragraph 2 (e) of the Delegated regulation (EU) 2019/331 as follows: for process emissions sub-installations, the preliminary annual number of emission allowances allocated free of charge for a given year shall correspond to the process-related historical activity level multiplied by 0,97 for the years until 31 December 2027 and by 0,91 for the years 2028 and onwards. We cannot support lowering the factor from 0,97 to 0,91 from 2028 onwards. We find the change of factor from 0,97 to 0,91 from 2028 onwards is unjustified and not realistic as technical opportunities to abate process emissions are not assessed and by our understanding not yet available EU-wide. It is important that we set values which are realistic and technology is available to support the abatement of process emissions. Therefore factor 0,97 shall not be reduced as long as the technical solutions are available and ready to be applied.

Eesti Keemiatööstuse Liit toetab kestlikku kemikaalide strateegiat, milline võtaks arvesse kemikaalide olulist rolli kliimaeesmärkide saavutamisel, tagades inimeste tervise ja keskkonna kõrgetasemelise kaitse, samas säilitades Euroopa keemiatööstuse ettevõtete konkurentsivõime. Jäätmete ja pakendijäätmete keemiline ringlussevõtt saab olema roheleppe tingimistes uus väljakutse Euroopa keemiatööstusele. EL uus, kestlikkust toetav kemikaalide strateegia peaks soodustama innovatsiooni ja digitaliseerimist materjalide ringlussevõtuks. Ülemaailmne kemikaalide tootmise suur kasv kolmandates riikides ja kiired tehnoloogilised muutused on peamised ELi kemikaalitööstuse ees seisvad probleemid. Põhikemikaalide tootmine väljaspool EL-i, on osaliselt tingitud sellest, et väga kõrged regulatiivsed nõuded ( osaliselt üle reguleeritud) EL-i määruste näol takistavad tootmist, eriti farmaatsiatooteid või biotsiide. Nagu näitasid hiljutised COVID-19 pandeemia sündmused, et regulatsioonide ajatutine leevendamine tõstis märgatavalt desinfitseerimisvahendite tootmismahte. Kahjuks ilma leevenduseta ei olnud võimalik Euroopa elanikel desovahendieid kättesaadavaks teha. Samas tõi COVID-19 kriis ka välja järelevalve nõrkuse, kuna tarbijateni tehti kättesaadavaks registreerimata desovahendid, palju toimus desovahendite ümbervillimisi teiste tootjate pakendisse, vältimaks registreerimisega kaasnevaid kulusid ja aktsepteeritud toimeainet . Selline tegevus on lubamatu ja tarbija tervist ohustav.
1. Euroopa Liidus juba loodud kemikaalide terviklik reguleeriv raamistik.
EL-s on REACH , mille rakendamine on aidanud kemikaalide vähendanud ohtu inimeste tervisele ja keskkonnale, tekitanud kõige põhjalikuma andmebaasi keemiliste ainete ohtude ja riskide kohta, samas tagades kemikaalide vaba liikumise kogu EL-s . Samas REACH - regulatiivne raamistik on takistanud ka vajalike kemikaalide väljaarendamist ja kodumaist tootmist. Näiteks uute ainete registreerimise kõrge hind pärsib teadusuuringute ja arendustegevust PPORD-protsessis. Nõustuda tuleks tegevuskavas esitatud ettepanekuga, mille kohaselt tuleb suurendada teadus- ja arendustegevuse rahastamist, kuid see peaks toimuma nii, et väiksemaid ettevõtteid ei jäetaks tahtmatult bürokraatia tõttu ilma.
Tulevase kestliku kemikaalide strateegia prioriteedid peaksid eelkõige lähtuma eelkõige hiljutises REACH toimivuskontrollis väljatoodud parendamist vajavatest lünkadest: dubleerimine, koormus ja menetluste tempo; rakendamine ja jõustamise eriti imporditud toodetele; ohtude ja ohutuse alase teabe edastamine.
Samuti CSS paeks keskendanuma mõne rakendusküsimuse lahendamisele: vajaduse korral registreerimistoimikute täiustamine, keerukamate andmenõuete selgitamine loomkatsete minimeerimisel, tarneahelates toimiva ja digitaliseeritud ohutu kasutamise teatise minimeerimine, riskijuhtimisevõimaluste analüüsi tööriista täiustamine, kuna erinevates õigusaktides on ebaühtlus riskijuhtimis otsuste kohta. Need lüngad tuleks täita õigusraamistiku lihtsustamine ja tugevdamise, mitte keemiatööstustele lisakoormuse lisamisega.

Absolute threshold
The Recital 12 of the Directive 2018/410 amending the ETS Directive provides the possibility to use absolute threshold to adjust the amount of free allocation in case of change in production. ECIA is of the opinion that the correction should be done also if the increase or decrease of the production level would lead to a significant change of the absolute amount of free allocation, but remains under the relative threshold 15%. As in current trading period, the threshold of 50 000 allowances should remain applicable also for the next trading period.
Exception from the allocation adjustment, if there is a good reason for temporary cease or decrease of activity
Considering that the purpose of ETS Directive is to promote the reductions of the greenhouse gas, there should be provided the exceptions where the temporary cease of activities or decrease of the activity level and respective emissions will not lead to the adjustment of the free allowances for next years. The Implementing Regulation should also promote temporary reductions of emissions and should not encourage emitting only in order to keep the amount of given free allowance.
ECIA proposes that the exceptions, where the allocations are not adjusted, should include at least the cases where the cease or decrease of the activity is due to exceptional and unforeseeable circumstances that could not have been avoided even if all due care had been exercised and that are beyond the control of the operator of the installation concerned, in particular because of circumstances such as natural disasters, war, threats of war, terrorist acts, revolution, riot, sabotage or acts of vandalism, as well as due to other good reasons coordinated with the competent authority (such as planned construction or reconstruction works of installation, and for operators engaged in the sectors with a high risk of carbon leakage also market failures and major changes in trading conditions with third parties and in market price).
Equal treatment of new entrants and changes in incumbent installations
ECIA agrees with and supports also the amendment proposals submitted to the Implemention Regulation by the Spanish Cement Association Oficeman and the Spanish Magnesite Association MAGES - that technical physical changes in incumbent installation entailing an amendment in the activity level should have equal treatment as new entrants. Otherwise, as in current draft regulation, there would be systematic discrimination with differential treatment of existing and new installation - the incumbent installation that carries out further technological improvements must cover the costs for the first two years for its emissions increases without any allocation, to the contrary of the new entrants, whose allocation during the first two calendar years will not be adjusted and will be based on their actual activity level.
