Response to Revision of the EU Emission Trading System Directive concerning aviation

Emirates Airline appreciates the opportunity to provide feedback on the Inception Impact Assessment on the revision of the EU ETS Directive 2003/87/EC concerning aviation. As a global airline providing connectivity between European cities and destinations worldwide, Emirates has been a participant in the EU ETS since coverage was extended to aviation. We applauded the decision by the EU to support momentum within ICAO towards the development of a global market-based measure by limiting the geographic scope of the EU ETS by way of derogations. Now that CORSIA has been adopted, we would urge that its core principles, as agreed by the Member States of ICAO, be placed at the heart of the revision of the Directive. Emirates acknowledges the necessity for the EU to amend the Directive before December 2023, to avoid the automatic reversion of the EU ETS to full scope. We would like to take the opportunity to share our views on the policy options. 1. EU ETS full legal scope: This option would conflict directly with CORSIA, resulting in overlapping regulation of international aviation emissions, and would risk reigniting international concerns over extra-territorial application of the EU ETS. 2. Intra-EU/EFTA ETS only: This option does not implement CORSIA, and therefore is in contradiction to the ICAO Resolution and ICAO Annex 16. 3. CORSIA only: This option fully applies CORSIA requirements in relation to international flights. 4. ETS-CORSIA “clean cut”: Under international law, flights between EU/EFTA Member States are still international flights, therefore subject to CORSIA. Third country operators flying on such routes would still be required to report their emissions on these routes to their State authorities, and include them in the calculation of their offsetting obligations, and so those emissions would be accounted for twice. If EU Member States were to exempt EU operators from CORSIA on these same routes, it would result in incomplete reporting, increase the potential for competitive distortion, and undermine the integrity of CORSIA as emissions on those routes would not be fully accounted for in the calculation of offsetting obligations. 5. ETS-CORSIA “mix”: This option needs further elaboration to determine the implications, including the administrative complexities of assessing route emissions under both schemes. Continued applicability of the EU ETS to non-domestic intra-EU/EFTA flights would be contrary to the principles of CORSIA if it resulted in the same emissions being accounted for twice. 6. ETS-CORSIA “mix” according to licence of aircraft operators: This option would result in incomplete reporting of CORSIA emissions on intra-EU/EFTA international routes. A key point to highlight is that certain options do not meet the criteria set in the Inception Impact Assessment document itself, where it says: “In order to avoid distortions of competition in comparable circumstances, it is important that all flights on the same route be treated in the same way”. In relation to auctioning and allocation, the scope of emissions coverage of the EU ETS under each of the policy options should be taken into account when assessing the economic impact. We also welcome the intention expressed in the Inception Impact Assessment document to seek stakeholder input on potential use of these revenues to contribute to emissions reductions. As a concluding comment, we would urge that the trajectory of industry recovery from the COVID-19 crisis, including the status and significance of international passenger and freight connectivity for EU and EFTA Member States, be fully considered when evaluating the social and economic impacts of changes to the EU ETS Directive.
