Response to Guidance to facilitate the designation of renewables acceleration areas

ENDESA, part of the ENEL Group, highly appreciates the EC initiative to provide to the Member States with Guidelines regarding the designation of renewable energy acceleration zone in accordance with the Renewable Energy Directive. In December 2020 the Ministry for Energy Transition of the Spanish Government commissioned an online tool which offered a preliminary assessment of the environmental sensitivity of the Spanish territory for the development of wind farms and utility-scale PV plants. The analysis is based on all the relevant information available both at country and regional level and offers a quantitative indicator (0-10) for each node in a 25m x 25m grid, 0 meaning the highest environmental sensitivity and 10 the lowest. The tool offers two different indicators, one for wind energy plants, and the other for utility-scale PV plants. The tool is periodically updated, particularly if new information pertinent to the analysis arises. This tool was designed as a support tool to be used both by developers and Administrations, to have a preliminary reference of the expected environmental sensitivity of a new plant location proposal, which may be helpful in order for developers and Administrations to prioritize those projects located in low sensitivity areas. Nevertheless, the tool does not preclude the result of the pertinent environmental assessment of a specific plant located in a low sensitivity area. Neither does it entail any streamlining or priority in the permitting process. It is important to remark that the tool was not designed to be used as a land use planning tool, as the legal competence for land use planning is held by each of the 17 Spanish Autonomous Communities. In our opinion this tool constitutes a good example of a best practice of available tools for identifying sites where the environmental impacts linked to wind and solar projects would be lower and good practices on the appropriate use of such tools which may be helpful as a reference point for other Member States intending to develop similar tools. We believe that the information provided by tool constitutes a good starting point for the definition of renewable acceleration areas (go-to areas) in Spain, as requested by RED III. Nevertheless, it will be crucial for the EC to consider the following key principles when providing guidance on designating renewables acceleration areas: - To ensure the coordination of the results of the zoning tool with the availability of renewable resources, availability of grid capacity and land use regulations constraints (which, as mentioned before, are defined by each Autonomous Community) - Strengthening stakeholder engagement and public participation, in line with the EU framework and the Aarhus Convention. Due to the complex process (lengthy procedures) and the different level of involvement (national, regional, local) at the Spanish side, the stakeholder participation should start as soon as possible. - To provide legal certainty, in particular with the Strategic Environmental Assessment (SEA). - To take into consideration the renewable capacity expected to be needed in a medium-long term timeframe, not limited to the 2030 renewable goals as defined in the NECP.
