Response to Directive of the European Parliament and of the Council on a Quality Framework for Traineeships

Traineeships should be available to all young people, with transparent information about benefits and social protection. For us, as a trade union, it is important that the status of traineeships is included in the collective agreements. Why? First of all, traineeships are an important springboard for young people to enter the labor market. In the light of the general weakening of trade unions, generally in Europe, the trade union should consider interns as future trade union members who would certainly contribute to strengthening the number of trade union members and thus be a factor in the long-term strengthening of the trade union. It is in the young members that the future of the trade union and the trade union movement lies. Secondly, introducing the status of traineeships in collective agreements will prevent employers from presenting regular employment relationships as traineeships. Since our branch union (Republican Trade Union of Employees in Banks, Insurance Companies and Other Financial Organizations of Serbia, RS BOFOS) is from Serbia, we will provide general information on how the status of trainees is resolved in the Labor Law of the Republic of Serbia. Interns' Rights to Earnings According to Article 47, paragraph 4 of the Labor Law, an intern is equal to other employees in all rights and obligations from the employment relationship. This means that he has the right to earn like any other employee. This is different from a professional training contract, where remuneration is optional. Amount of Earnings The intern's salary is determined by Article 109 of the Labor Law. According to this article, the salary can be contracted at least in the amount of 80% of the basic salary for the jobs for which the trainee concluded the contract. This also includes the right to reimbursement of expenses and other benefits in accordance with the general act and the employment contract. Calculation of Earnings and Taxes For employers who employ apprentices, there are no specifics in the calculation of wages. The calculation of salary tax and contributions for mandatory social security is done in the same way as for other employees.
