Response to EU rules on medical devices and in vitro diagnostics - targeted evaluation

MedPharmPlast Europe (MPPE), sector group of European Plastics Converters (EuPC), appreciates the opportunity to contribute to the targeted evaluation of the EU rules on medical devices and in vitro diagnostics. We recognize the importance of a single EU Regulation, which provides a harmonized framework across all Member States, ensuring consistency and an equal playing field for all stakeholders. However, we wish to emphasize significant inefficiencies and burdens within the Regulation that have yet to be addressed. The classification rules on nano-content and animal-derived materials are overly restrictive: 1. Automatic classification to at least class II if a nano has been used, e.g. for surface devices. In many cases there are no additional risks compared with general consumer goods, so Class I should still be possible. 2. The definition of animal-derived materials is ambiguous, making it unclear at which point in the supply chain substances cease to be considered animal-derived. A revised definition should only include materials physically derived from human or animal tissue or cells, not those chemically derived, such as chemicals and polymers.
