Response to Report on the evaluation of the LULUCF Regulation

The European Association of Remote Sensing Companies (EARSC) is a trade association representing over 135 company members across Europe in the Earth Observation (EO) industry. EARSC welcomes the European Commission's efforts to assess the implementation and impacts of the revised Regulation on land use, land use change, and forestry (LULUCF) in Member States since its adoption in 2018, evaluate to what extent the Regulation is still fit for purpose in the context of the EUs 2050 climate neutrality goals, and identify which lessons can be learned from the implementation of the regulation and identify where there is room for improvement. Response to Mid-term evaluation of the Space Programme

The European Commission (EC) is tasked with the responsibility of assessing the execution of the Programme, as outlined in Article 102 of Regulation (EU) 2021/696. This regulatory framework encompasses a range of critical initiatives, including Galileo and EGNOS, Copernicus, Space Situation Awareness for space surveillance, and GOVSATCLOM for satellite and CASSINI. The European Association of Remote Sensing Companies (EARSC) and its members acknowledge the EC for its endeavors in promoting the adoption of Copernicus data and services, as well as commercial solutions in Earth Observation (EO). This support is particularly notable on the policy front, exemplified by the regulation addressing deforestation-free products and the introduction of innovative procurement approaches, such as Dynamic Purchasing Systems (DPS). However, EARSC raises several concerns: Clarity of Program Outcomes: There is a challenge in understanding the tangible results emerging from the program, especially when considered in conjunction with the budgetary allocations for the European Space Agency (ESA) and Entrusted Entities. Procurement Challenges: EARSC expresses apprehension about the procurement rules, which have inadvertently led to competition between industry and institutions. Instances of Entrusted Entities bidding to tenders launched by another Entrusted Entity and the involvement of third parties, such as the USA, in these processes. Insufficient Focus on Commercialization and Internationalization: There is a perceived lack of substantial efforts or actions aimed at providing support for commercialization and fostering internationalization. These aspects are pivotal components for strengthening the European Space Industry and ensuring its competitiveness on a global scale. In light of these concerns, EARSC emphasizes the need for a more transparent communication of program outcomes, a reassessment of procurement rules to mitigate competition issues, and a strategic focus on initiatives supporting commercialization and international collaboration. EARSC very much welcomes the efforts of the European Commission to harmonise the EU approach to safety, sustainability, and resilience and ensure the long-term longevity of the European space domain. As such, we have prepared the attached letter to express the views of our association and our members.

Response to Soil Health Law – protecting, sustainably managing and restoring EU soils

The European Association of Remote Sensing Companies (EARSC) is a membership-based, trade association based in Brussels. We represent the European Downstream services sector creating added-value services and products based on Earth Observation satellite data; we have more than 135 members across 25 European countries. The companies in the downstream sector develop services and applications in many areas, including soil health monitoring. EARSC is involved in different projects and activities to support them and promote the use of Earth Observation solutions in a variety of sectors. EO represents an opportunity to obtain reliable, timely and continuous information and EARSC is convinced that the unprecedented digital tools and data being provided by the Copernicus Earth Observation Programme, combined with the European industrys unique analytical know-how and technological skills are the foundational pillars to build upon for acting, monitoring, and mitigating threats for municipalities, regions and countries. EARSC welcomes the EU Soil Strategy for 2030 aiming to have all EU soils in a healthy condition by 2050. The European Commission is consulting on this legislative proposal on soil health complementing the proposal for a regulation on carbon removals, the Nature Restoration Law and, ensuring synergies with climate change mitigation and adaptation actions.
