Response to Commission Reg. (EU) on the application of control & mitigation measures to reduce the presence of acrylamide in food

The European Coffee Federation (ECF) would like to make the following observation with regard to document SANTE/11059/2016, Annexes to the Commission Regulation (EU) establishing mitigation measures and benchmark levels for the reduction of the presence of acrylamide in food: In Annex III (sampling and Analysis Requirements), sub II (Frequence of sampling), the text is not always clear. In particular, do FBOs have to analyse all the products within a product type or a representative sample of the product type? There is an apparent mismatch between paragraph 2 (‘FBOs shall ensure that a representative sample of each product type is taken for analysis of acrylamide concentration’) and paragraph 4 where there is no reference to ‘product type’ but only to ‘products’ (‘FBOs shall undertake sampling and analysis at least annually for products that have a known and well-controlled acrylamide level. FBOs shall carry out higher frequency sampling and analysis of products having the potential to exceed the benchmark level.’). ECF recommends reviewing and where appropriate revising these provisions to make them unambiguous, which is in the interest of both FBOs and inspection authorities.
