Response to Cross-border e-Justice in Europe (e-CODEX)

We see that the proposal is assessed as being in full compliance with article 47 of the Charter of Fundamental Rights. The possibilities created by the e-CODEX electronic system would have a positive impact on the ability to exercise the right to an effective remedy, and are in conformity with Article 47 of the Charter of Fundamental Rights ´Right to an effective remedy and to a fair trial´ since electronic communication and document transmission enhances and reduces the time of the court proceedings. The European Network of Councils for the Judiciary (ENCJ) would like to point out that article 47 also guarantees the right to an impartial and independent tribunal. In relation to the future governance and coordination of e-CODEX and e-CODEX-related activities we believe that the independence of the judiciary needs to be guaranteed as well. The ENCJ offers its co-operation to assess how this could be best organised.
