Response to Initiative for reviewing and prolonging the “Roaming Regulation”

We welcome the revision and recast of the RLAH regulation and the lifting of certain regulatory obligations providing for more clarity. However, the RLAH proposal presents some critical issues concerning the value of the wholesale caps for data and voice and the inclusion of certain provisions concerning quality of service, value-added services and access to emergency services that could generate more costs and complexity for operators to the detriment of end-users at the end. Regarding wholesale caps for voice and data, their values are still excessively high and will produce negative effects for competition and end-users alike. In particular, the wholesale caps proposed by the European Commission will: i) render the RLAH mechanism unsustainable for smaller mobile operators and MVNOs; ii) hamper competition between operators to the detriment of end-users, innovation and competition on prices and services offered; iii) render costs level incompatible with the evolution of offers in the retail market; iv) not consider the relevant increase of data traffic consumption per SIM compared to the decrease of retail prices; v) differ significantly from the national wholesale costs for voice and data services, while similarities of costs should be at the core of RLAH mechanism. It is crucial thus to reduce the wholesale caps further, namely at the level of domestic costs. Regarding the inclusion of quality of service, value-added services and emergency services we consider the following: 1) requesting roaming providers to ensure the same quality of service to end-users domestically and abroad is not feasible due to differences in terms of coverage and technologies of the different networks within the European Union. Moreover, the quality of services abroad does not depend on the home operator, which does not have any control on the performances of the network located in the visited Member State. We invite thus the European Commission to delete in art 5(2) and 9(3)(c) the reference to quality of service. In case the European intends to maintain the provision of the quality of service in article 5(2) we then suggest that the exception of “when technically feasible” remains; 2) the obligation on roaming providers to inform the customers through a welcome SMS of value-added services, including a hyperlink to the types of value-added services and on their numbers’ ranges is too burdensome and costly. Thus, only operators providing such services should be subject to that obligation. In any case, the information via hyperlink should not be free-of-charge; 3) the obligation to inform customers by SMS of alternative means of access to emergency services chosen by every single visited Member States, implies that roaming providers will be obliged to issue customised SMS for every Member State. This will generate more costs and reduce clarity concerning emergency access in the EU. The only reference to 112 Emergency call is preferable as the number has been already harmonised in almost every Member State. Finally, concerning the process review, the participation of stakeholders to the process should not be reduced to a simply filling of a questionnaire but should cover all the different steps of the review process. This is crucial considering that the potential amendments of the wholesale caps will affect substantially operators and their business.
