Response to Ecodesign for Sustainable Products - Product priorities

FEBELCEM, the Belgian Cement Association, is grateful for the opportunity to provide input to this consultation and supports the Commissions non-inclusion of cement in the new product priorities for Ecodesign for Sustainable Products and keeping it under the Construction Products Regulation (CPR). For FEBELCEM, the CPR has a crucial role to play in supporting the delivery of low carbon construction materials through a timely, flexible and harmonised standardisation process. In FEBELCEMs view, the CPR offers the best framework to support the development of low carbon cements whilst recognising its specificity as a product which is only used in the construction industry. Cement is already a priority sector under the CPR, with the acquis process including environmental aspects scheduled to start mid-2023. Putting cement both under the CPR and the ESPR could delay the current process and even lead to conflicting legislations. In this respect, the major elements to consider are the following: 1. Significant efforts are deployed by the EU cement industry to bring low-carbon cements into the market 2. Cement is a B2B product used exclusively in the construction sector & the ESPR is not a sustainable framework for cement 3. A clear framework for the development of standard is planned for the CPR, with cement identified as a priority We thank you for taking our contribution into account and keeping cement exclusively within the scope of the CPR.

Response to Evaluation and revision of the Weights and Dimensions Directive

FEBELCEM, la Fédération de l'industrie cimentière belge, est favorable au poids de 44 tonnes comme poids de base au sein de l’Union européenne. Toutefois, la possibilité doit pouvoir être laissée aux Etats membres d’augmenter le poids maximal au-delà des 44 tonnes. Dans ce cadre-là, il est important d’assurer une cohérence au sein de la Directive pour les situations transfrontalières en permettant aux Etats membres voisins d’organiser un passage transfrontalier considérant le plus grand dénominateur commun entre ces Etats. Par exemple, lorsqu’un EM autorise le 44t, de l'autre côté de la frontière un autre EM autorise le 48t : le passage de la frontière serait possible avec le 44t. Il convient également d’interdire le maintien artificiellement bas d’un poids national (par exemple, un poids national faible avec des exceptions uniquement sur le territoire national) pour éviter un protectionnisme national et une concurrence déloyale entre Etats membres ainsi que pour protéger l’environnement et assurer la sécurité routière. Des exceptions vers le bas ne peuvent être clairement et scientifiquement motivées que pour des parties fragiles spécifiques de l'infrastructure (jamais pour la totalité du territoire).
