Response to Revision of EU rules on late payments (Late Payments Directive)

We believe that the revision of the Late Payment Directive is a good initiative since we consider that there are some deficiencies in it that should be corrected: Establish a homogeneous and reliable method for calculating the Average Payment Period. Follow-up and surveillance of compliance must be carried out in the most sensitive and critical sectors such as the health sector. Establish sanctioning measures from the European Commission towards the Member States in the case of non-compliance with the Late Payment Directive by public administrations. Establish a standardized invoice compliance process, which includes the minimum requirements that an invoice must meet and which, once met, do not allow its rejection, in order to avoid the current long compliance times. Inclusion of a penalty regime for late payment and publication of a list of organizations in default. In the private sphere: do not allow access to public contracting, nor access to subsidies. We make our Late Payment Observatory available to anyone who is interested, which collects data on payment behavior of the public sector (Hospitals and Health Services) in the field of Health Technology.
