Italian steel industry urges broader scope for trade safeguards

Why — This would protect EU producers from being undercut by importers who use loopholes to minimize their carbon costs.3
Impact — Foreign exporters and importers lose the ability to understate emissions by rerouting products or averaging carbon data.45

Response to Extension of the scope of the carbon border adjustment mechanism to downstream products and anti-circumvention measures

Federacciai, the Federation of Italian steel companies, welcomes the opportunity to contribute to the consultation on CBAM downstream extension and additional anticircumvention measures. CBAM, which works alongside the gradual phase-out of free ETS allowances for EU producers, risks to be completely ineffective or even counterproductive in tackling the risk of carbon leakage, if not thoroughly revised before it fully comes into effect in 2026. The recent simplifications approved in the omnibus package fail to address the structural issues of the mechanism. The extension of the scope to steel intensive downstream products and the addition of new effective measures to minimise the risk of circumvention are indeed two essential elements that should be part of the revision. In this respect, please refer to the attached detailed contribution of the European steel association (Eurofer) which we support. A table with the list of additional CN codes to be added to CBAM scope is included in the document. The risks of CBAM circumvention (in their various forms) are extremely high for steel, as described in detail in the attached document and need to be tackled by strengthening and simplifying the mechanism at the same time. In addition, the CBAM free allocation adjustment and the setting of CBAM benchmarks need to be designed very carefully to avoid detrimental consequences. CBAM benchmarks for long products and for stainless steel need to reflect the best environmental practices and the very high recycled content of European producers. If this is not correctly designed, in the case for instance of long products made in EU by scrap-based EAF route, the CBAM would allow, or even encourage, the replacement of recycled steel produced in the EU with imports of products made from virgin raw materials (DRI based) and with much higher carbon footprint. This would clearly contradict the very objectives for which the mechanism was created. Finally, in addition to the issues strictly covered by this consultation, it is of utmost importance to find a solution for the EU export of CBAM goods, to avoid that European products, burdened with rising ETS costs, will be completely unable to compete in international markets. Overall, if all these issues are not properly solved and CBAM proves ineffective in addressing carbon leakage, the phase-out of free ETS allowances should be reassessed, allowing businesses engaged in the transition to complete their decarbonisation without compromising competitiveness.
