Response to Revision of the Machinery Directive

FederUnacoma is of the opinion that the Machinery Directive is overall fit for purpose and therefore, does not support changes to its substance which may offset the stability that it has given machine manufacturers for more than a decade. On the other hand, we welcome procedural adaptations such as the alignment with the NLF and the conversion into a Regulation. An explicit permission to use digital documentation is strongly recommended, since it would decrease administrative burdens for economic operators and additionally trigger positive impacts for the environment by reducing the production of paper documentation. FederUnacoma is the Italian federation of farm machinery manufacturers. It includes more than 300 Companies for an estimated turnover of more than EUR 6 billion.

Response to Noise emission by outdoor equipment

FederUnacoma represents 300 companies, mostly SMEs, that produce agricultural machinery and gardening equipment; all the gardening equipment are subject to directive 2000/14/CE, that therefore has a huge impact on the design and the sales of these products. FederUnacoma welcomes the revision of directive 2000/14/CE after a long period of implementation since several Studies have been completed over the years and have provided new facts and figures to address the adaptation to technical progress. FederUnacoma asks for a full revision of the directive 2000/14/CE in order to guarantee the alignment with the New Legislative Framework, based mainly on self-certification for all the products and harmonized standards for the noise measurement methods (test codes). In addition, FederUnacoma believes that the Scope should be completed with new electrically powered pieces of equipment, which are steadily increasing their market shares, and that new noise emission limits should be taken into consideration only if based on factual data and without neglecting the noise coming from the working operation (process noise). As minor topics, there is a need to mention the noise marking and the collection of noise data that should be both improved or removed from the drafting legislation, since they proved to be not adequate to inform effectively the customers.

Response to Road circulation requirements for mobile machinery

As Italian Association of agricultural machinery manufacturers, we are glad with the initiative to achieve a single market for mobile machinery. We feel a strong necessity for harmonisation of the road circulation legislation taking into account the complexity of existing technical and sector specific requirements. The goal must be one full EU conformity procedure without multiple approvals for obtaining permission to travel on public roads. Only having system approvals is not favoured by the industry. The conformity procedures must be such that administration and testing requirements do not produce any unnecessary costs for manufacturers of the many low volume highly specialised machines. This harmonization will reduce the redundant extra testing in each member state. The new legislation must ensure a high level of on-road safety of mobile machinery. FederUnacoma supports: - as a first option, EU Type-approval by National Authorities (e.g. Ministry of Transport); - it could also be acceptable to have New Legislative Framework with tests on the most critical requirements and documental checks on the less critical ones carried out by Notified bodies (including Ministry of Transport). The first policy option (EU Type-approval) is the most suitable for SMEs because it gives total protection to the manufacturers. A dedicated working group under the lead of the Commission must be set-up. It is overall recognised that the most suitable Member States experts to seat in such working group come from the transport ministries. Apparent Interference between any existing legislation as other EU legislation applying to machinery for the road, and the future new legislation, must be minimized and clarified. We like to repeat that the new legislation must be without prejudice to national non-technical requirements for road circulation such as prohibition to cross a bridge, to drive across a town, and speed limitation.
