Response to Recognition of parenthood

As Forbidden Colours, we welcome the initiative regarding the recognition of parenthood of all parents in the European Union. As has been ruled several times by the European Court of Justice, a parent in one country is a parent in another country. While this initiative is very timely, Forbidden Colours does encourage the Commission to do more to actually enforce already existing case law. In the Baby Sara case, the Court of Justice of the EU has already ruled in December 2021 that parenthood recognized in one Member State must be recognized in all EU Member States. Yet, the European Commission has still failed to take measures to make sure that Bulgaria complies with the ruling. With this proposal, the EU institutions are set for a very long legislative procedure. At the same time, children living in rainbow families are still lacking recognition of their fundamental rights. Therefore, Forbidden Colours expects the European Commission to start infringement proceedings against member states failing to adhere the Court of Justice rulings, such as Bulgaria in the case of Baby Sara.
