Response to Greenhouse gas emissions savings methodology for low-carbon fuels

Fortescue has a strong focus on decarbonisation, evidenced by its industry leading target to achieve real-zero carbon emissions across our terrestrial mining operations by 2030. Fortescue are establishing a global portfolio of renewable energy, green hydrogen and derivatives, battery system and green technology projects and operations that are at the forefront of the global energy transition. Fortescue welcomes the opportunity to respond to the public consultation on the methodology to determine the greenhouse gas (GHG) emission savings of low carbon fuels. To reduce carbon emissions in critical sectors such as steel, shipping, aviation, and fertilizers, clear and rigorous standards and methods for measuring emissions are essential. Our recommendations highlight the importance of strong measurement, monitoring, and verification practices to ensure that genuinely low-carbon hydrogen contributes effectively to decarbonisation goals. Given the growing calls for technologically neutral solutions that allow competitive decarbonisation, it is critical that different pathways have similarly rigorous methodologies. Fortescue supports the principle of aligning the DAs for RFNBO and low-carbon fuels to ensure consistency of the rules. The Commission's delegated authority mandates that low-carbon hydrogen production must achieve at least a 70% reduction in greenhouse gas emissions compared to the liquid fossil fuel benchmark, allowing a maximum of 3.38 kg CO2-equivalent per kg of hydrogen. To align with the EU's binding goal of reaching climate neutrality by 2050, the threshold for defining "low-carbon" hydrogen should gradually decrease to 2 kg by 2040 and further to 1 kg by 2050.

FFI appreciates the opportunity to provide feedback to the Delegated Act and intends to take account of the Commission's kind offer made during the stakeholder event on the Delegated Act on renewable hydrogen for participants to make pertinent submissions bilaterally at a later date, as we are still evaluating the second Delegated Act and its interaction with the first.
