Response to Revision of the REMIT Implementing Regulation on data reporting

Fortia Energia S.L. welcomes the opportunity to contribute to the consultation on the draft REMIT Implementing Regulation. In this way, we have identified a drafting inconsistency in the draft REMIT Implementing Regulation concerning the duration threshold for gas storage contracts subject to periodic reporting: Article 4(5)-(6) states: concluded for a period of 12 months or longer (12). The Explanatory Memorandum describes the scope as gas storage contracts with a duration of more than 12 months (>12). Elsewhere in the Explanatory Memorandum, the wording 12 months or longer is used. Request: please align all references with Article 4(5)-(6), i.e., 12 months (12 months or longer) to ensure legal certainty and consistent implementation.
