Response to Amendment of conformity assessment procedures for EU fertilising products

We kindly request for clarification in the text of the proposed regulation: 1. On page 2 in the EXPLANATORY MEMORANDUM in point 1 "CONTEXT OF THE DELEGATED ACT", it should be clarified which test is meant, because it is only generally stated that: "Under the current rules, the test may be performed by any laboratory chosen by the manufacturer. A notified body with accreditation to perform inspections must supervise the testing." 2. In the attached draft delegated regulation - module A1, only and exclusively the detonation resistance test is mentioned. In accordance with Regulation 2019/1009, in module A1, the detonation resistance and oil retention tests are always performed together for the assessment of conformity. Therefore, does the reference in the content of the delegated regulation on amendments to Regulation 2019/1009 only to the detonation resistance test result from the fact that there were no objections to the laboratories performing the oil retention test (all are accredited)? If not, then the newly introduced regulation should include both tests: oil retention and detonation resistance.

Grupa Azoty supports the principles of sustainable development, with particular emphasis on those aimed at guaranteeing food safety. Due to the possibility of expressing an opinion on the revision of Commission Regulation (EU) No 10/2011 on plastic materials and articles intended to come into contact with food, we draw attention to the following issues that are important to take into account in legislative work and in a possible legislative proposal. We also ask for clarifications in the interpretation of several provisions. 1. New wording of Article 8 on General requirements of substances states that Manufacturers of plastic materials and articles and of products from intermediate stages of their manufacturing shall know the composition of the substance and make it available to the competent authorities on request. a) How it translates into any obligation of the manufacturer of substance to disclose its composition? b) What is the rule imposed on manufacturer of substance to disclose the composition of substance? c) What is a definition of composition regarding to requirements of Article 8? Is it the degree of purity; content of polymer, particular additives, polymer production aids, NIASes, aids to polymerisation? 2. A new article 14a should be article 15a. 3. Annex IV, point 8 introduces an additional requirement to be included in the declaration of conformity, i.e.: (iv) the maximum lifespan of the material or article based on a report evaluating the maximum lifespan of the material or article taking into account the elements set out in Article 10(3); a) Please clarify whether this obligation will apply to base polymers in the form of granules? b) Please define the term "lifespan" which is not defined in Regulation (EU) 10/2011. Such details should be included in the upcoming amendment of the 10/2011 Regulation.

Response to Measures to reduce microplastic pollution

Grupa Azoty, as a company operating in accordance with the principles of sustainable development and respecting environmental protection aspects, supports all measures aimed at preventing environmental pollution, including the unintentional emission of microplastics into the environment. At the same time, we would like to point out that, as a manufacturing company, we meet a lot of legal requirements that effectively prevent the unintentional emissions of pollutants into the environment, e.g.: BAT reference documents, requirements contained in integrated permits and other acts. The company's operations are also conducted with an the integrated management system, including ISO 14001. Nevertheless, we draw attention to several aspects presented in the proposal of the regulation (details in the attachment).
