Response to Access to Justice in Environmental matters

Instituto Internacional de Derecho y Medio Ambiente (IIDMA) is an environmental law organization established in 1997 to contribute to environmental protection and sustainable development through the study, development, implementation and enforcement of the Law. As such we consider of utmost importance to review the EU Aarhus Regulation not only on the terms proposed in the roadmap but also the review must be extended to the points indicated in the comments submitted by ClientEarth and by J&E, organization we are members of. One of the values of the EU is the rule of law. However, without the possibility for NGOs to have a broad access to justice rule of law is weak. At this moment in which the whole EU and the Planet is hit by coronavirus it is time for the EU to reflect and to introduce urgent reforms to allow citizens to contribute to a better Planet. We cannot continue within the same path. Without access to justice that is not possible. Many scientific studies are warning that trespassing planetary boundaries through biodiversity depletion, climate change and the increase of the nitrogen presence is contributing to the spread of unknown viruses. We are experiencing the impact this has in our society and the economy. Because of the limited possibilities of access to justice including the limited scope of the RIR, many activities have been allowed causing irreversible damages to the environment and our Planet. Therefore, if the commitment of the EU is as specified in the EU Green Deal, access to justice must be broaden and the EU Aarhus Regulation has to be reviewed in the terms commented by ClientEarth and J&E.
