Response to Digital Networks Act

Die ISPA als Verband der österreichischen Internetwirtschaft bedankt sich für die Möglichkeit, im Rahmen des gegenständlichen Call for Evidence der Europäischen Kommission zu einem möglichen zukünftigen Digital Networks Act Feedback geben zu können. Die ISPA hat bereits im Rahmen der Konsultation zum im Vorjahr veröffentlichten Weißbuch How to Master Europes Digital Infrastructure Needs?1 der Europäischen Kommission ausführliches Feedback zu den meisten der Themen gegeben, die im Rahmen dieses Call for Evidence relevant sind und verweist auf ihre Ausführungen. Als Verband der österreichischen Internetanbieter mit mehr als 200 Mitgliedern aus allen Bereichen der Internetwirtschaft, die stark von den Auswirkungen des geplanten Digital Networks Act betroffen sein werden, möchten wir an dieser Stelle erneut auf einige zentrale Punkte im beigefügten Dokument aufmerksam machen.

Der Verband der österreichischen Internet-Anbieter ISPA bedankt sich für die Möglichkeit, im Rahmen des gegenständlichen Call for Evidence an der gem. Art. 23 der Verordnung zur Bekämpfung der Verbreitung terroristischer Online-Inhalte1 (im Folgenden kurz TCO-V) vorgesehenen Evaluierung teilnehmen zu können. Die ISPA hat sich bereits seit dem Gesetzgebungsprozess mit der TCO-V beschäftigt und die Entwicklungen auf europäischer und nationaler Ebene vor und nach deren Inkrafttreten beobachtet. Zahlreiche Mitglieder der ISPA sind als Hostingdiensteanbieter von den Pflichten der Verordnung betroffen und haben für die Erarbeitung dieser Stellungnahme ihre Erfahrungen geteilt. Festzuhalten ist, dass die ISPA und ihre Mitglieder die Zielsetzung der TCO-V grundsätzlich begrüßen. Die rasche Entfernung terroristischer Online-Inhalte stellt eine wichtige Maßnahme für die Schaffung sowohl eines sicheren Online-Umfelds als auch für die Förderung der öffentlichen Sicherheit an sich dar. In Österreich besteht derzeit eine gute Zusammenarbeit der Diensteanbieter mit der zuständigen Kommunikationsbehörde Austria (KommAustria) bei der Klärung über und der Bewältigung der aus der TCO-V entstehenden Pflichten. Dennoch weist die derzeitige Fassung der Verordnung einige Mängel auf, die aus Sicht der ISPA im Rahmen eines Legislativvorschlags repariert werden sollten. Mit den vorgeschlagenen Überarbeitungen kann sichergestellt werden, dass einerseits die Ziele der Verordnung bestmöglich erfüllt werden und es andererseits zu keiner ungewollten Überbelastung der betroffenen Diensteanbieter kommt. Die ISPA Internet Service Providers Austria ist der Dachverband der österreichischen Internet Service-Anbieter und wurde im Jahr 1997 als eingetragener Verein gegründet. Ziel des Verbandes ist die Förderung des Internets in Österreich und die Unterstützung der Anliegen und Interessen von über 200 Mitgliedern gegenüber Regierung, Behörden und anderen Institutionen, Verbänden und Gremien. Die ISPA vertritt Mitglieder aus Bereichen wie Access, Content und Services und fördert die Kommunikation der Marktteilnehmerinnen und Marktteilnehmer untereinander

ISPA - Internet Service Providers Austria welcomes the Commissions initiative to continue reporting on how the rules of the GDPR have been applied, 6 years after their entry into application and the opportunity to provide comments to the Report on the GDPR. ISPA Internet Service Providers Austria is a voluntary business representation and act as the voice of over 220 internet service providers from various fields all along the internet value chain in Austria. Moreover, the majority of ISPA members are SMEs, and as such,face novel challenges from any new requirements.

ISPA - Internet Service Providers Austria welcomes the opportunity to comment on the draft implementing regulation on transparency reporting under the Digital Services Act (DSA). ISPA is the Austrian association of Internet Service Providers, representing approximately 230 ISPs. ISPA is a major voice of the Austrian Internet industry. Our goal is to shape the economic and legal framework to support optimal growth of the Internet and Internet services. We regard the use of the Internet as an important cultural skill and acknowledge the resulting socio-political responsibilities ISPA welcomes the Commission's intention to ensure the quality and level of harmonization of the transparency reporting obligations imposed on providers of intermediary services with this implementing regulation. However, care should always be taken to limit reporting obligations to what is absolutely necessary and not to burden providers in an already highly regulated sector even more than absolutely necessary. Specifically, ISPA hereby submits the following feedback on the draft.

Dear Sir/Madame,
ISPA (Internet Service Providers Austria) is pleased that the European Commission has issued this public consultation on the Proposal for a Regulation on European Production Orders for electronic evidence and would like to share its position on this important subject. With its detailed contribution attached in the file bellow ISPA would like to draw the European legislator’s attention to some major issues.
ISPA considers the inclusion of cost reimbursement in the proposal as a positive step, but as it remains a national prerogative, it cannot be used EU-wide as a potential tool to disincentivise judicial authorities from issuing bad faith or frivolous orders. For example, a nominal fee per Production Order could serve as a check on the volume of orders sent out.
ISPA feels compelled to request that national authorities in the receiving state need to be under the obligation to assess the necessity as well as the proportionality of any incoming Order and stresses the negative consequences that will arise from any framework that privatises law enforcement and does not provide clear safeguards for ISPs. Furthermore, ISPA emphasises the need for SME exemptions to offset the considerable administrative, legal and financial burden incurred by the cooperation and the extremely ambitious timeframes suggested by the e-evidence proposal.
The ISPA's contribution attached in the file bellow elaborates in detail on these and other very important issues in the European proposal on e-evidence.
