Response to Proposal for a Directive on cross-border activities of associations

Kellen is one of the worlds largest providers of management and services to ‎associations and trade organizations. Kellen serves some of the leading ‎global organizations from offices across Asia, Europe and the United States, ‎along with strategic representation in the Middle East and South America. ‎We are the leading association services provider to organizations with ‎international footprints, and actively engage with companies, governments ‎and professionals across geographies and languages to form global ‎coalitions and alliances to achieve our partners goals.‎ A significant number of the associations that we manage from our Brussels ‎office have the Belgian aisbl status but are carrying out activities across the ‎European Union. We therefore believe that the ECs initiative to analyse ‎cross-border activities of associations is important.‎ In terms of policy response, we support a new legal form for associations ‎allowing for recognition in all Member States but consider harmonising ‎common minimum standards for cross-border operations in the ‎EU as fall-‎back policy response. Non-profit associations operating in one EU Member ‎State, should have simplified administrative requirements in other EU ‎Member States when carrying out their activities.‎ As far as it concerns restrictions on cross-border activities of associations, ‎we find the registration to VAT for conferences and events of our clients ‎across the EU problematic. Although these associations are registered to ‎VAT in their country of residence, they have to get a temporary registration in ‎the countries where they organize conferences and events. We therefore ‎suggest that host countries VAT administrations take into account the ‎existing home country registration and use the VAT Information Exchange ‎System (VIES) to facilitate temporary registrations to VAT.‎
