Response to Targeted revision of the EU system of tobacco traceability

The Danish Cancer Society welcomes the call for feedback to the review of the rules that set out EU standards on tracking and tracing of tobacco products. We support the establishment of the EU tracking and tracing system for tobacco products. However, since the Commission has not yet published reports on the efficiency and results of the system, we find it difficult to provide feedback on the real effects of the tracking and tracing system. Further, we are very concerned about the independency of the system and the possibility of the tobacco industry to influence it. The European Union is a party to the FCTC Protocol to Eliminate Illicit Trade in Tobacco Products, which requires Parties to establish independent tracking and tracing systems and not to delegate their responsibilities under the Protocol to the tobacco industry. In the EU system, the tobacco manufacturers and importers nominate data repositories and auditors. The industry nomination has to undergo approval by the European Commission based on criteria for independence established in secondary legislation. Nevertheless, sev-eral of the appointed data repositories we found to have long-standing, documented rela-tionships with the tobacco industry. Consequently, there are some evidence to indicate that the control mechanisms might be under the influence of the tobacco companies, which pay and choose the auditors. In addition, the scope of the duties for auditing is too limited. According to Article 15.8, auditors should assess in particular any irregularities in relation to access of the data storage fa-cilities, but not whether the companies, which generate the unique identifiers for the Member States use questionable software from providers that have links with the tobacco industry. The Danish Cancer Society therefore recommends that tobacco industry involvement in the EUs tracking and tracing system should be limited strictly to absolutely necessary involvement. We suggest the following steps: - strengthening the independence criteria for data storage facilities and companies who generate the unique identifiers -auditors and data storage facilities should be selected by Member States or the Commission -publishing the auditors reports and the names of the auditors as well as Commission reports on the efficiency and results of the system - extending the scope of audits to assess the way unique identifiers are generated particularly without the use of questionable software.

Response to Revised recommendation on smoke-free environments

The Danish Cancer Society welcomes the call for evidence to update the recommendations on smoke-free environments, as tobacco smoke is carcinogenic and there is no safe level of exposure to tobacco smoke. There is an urgent need for review of the EU tobacco recommendations and directives, if we are to achieve the target of the Europe’s Beating Cancer Plan where less than 5 pct. of population smoke by 2040. We fully support the extension of the definition of the products covered by the Recommendations to include e-cigarettes and heated tobacco. It is important that the recommendations include all types of emissions, including aerosols and smoke from tobacco and nicotine products. In this way, the legislation will also cover future emerging products such as for instance hybrids between e-cigarettes and heated tobacco. We also find it very important to recommend that all indoor locations are smoke-free, and that this includes all forms of partial outdoor coverage. In Denmark, there are exceptions to the Act on smoke-free environments, which unfortunately means that there is a lack of protection against exposure to tobacco smoke in smaller pubs, in private day care homes and in the care sector, e.g. nursing homes. Semi-outdoor locations, which are partially covered by roofs or walls are not included in the current Danish smoke-free legislation, which is a loophole exploited by the hospitality sector. It is also positive that the proposed Recommendations will include certain outdoor areas. In our opinion, it is especially important to focus on places where children and adults have to stay, e.g. waiting areas by public transport, or outdoor areas of health care facilities and places where many people are gathered e.g., playgrounds, parks, beaches and pedestrian streets. In Denmark, smoke-free school hours in primary school, high schools and vocational schools have been adopted in the national legislation. This means, that students are not allowed to smoke during school hours not even if they leave school premises. Similarly, the main part of the municipalities have introduced smoke free work hours for their employees. We recommend that the Council includes these measures in the Recommendations. In addition, the Recommendations should encourage individual member states to adopt legislation that explicitly enables housing associations to adopt rules on e.g. smoke-free balconies, smoke-free common areas or smoke-free housing. The Recommendations should also encourage individual member states to launch public awareness campaigns designed to inform the public about the harmful effects of second hand smoke and the benefits of making private homes and vehicles smoke-free.
