KWS Urges Stronger Intellectual Property Protections for Breeders

13 Mar 2025
Message — KWS seeks updated laws to ensure breeders receive fair returns on research investments. They demand mandatory reporting on farm-saved seeds without needing prior evidence of use. The group requests clearer rules to prevent new technologies from copying original plant varieties.123
Why — Stricter royalty rules and reporting would increase KWS's financial returns on plant innovations.4
Impact — Farmers would face higher costs and more paperwork when reusing their own seeds.5

Response to Revision of the plant and forest reproductive material legislation

6 Dec 2023

KWS welcomes the proposal of a harmonized approach for seed marketing. The current regulatory framework guaranteed the development and marketing of high quality, safe and highly performing seeds. The strategic drivers coming from climate change, digital processes and the need for a sustainable food system mean that updated regulation is appropriate. To this end, we welcome the provisions aimed at maintaining and reinforcing the possibility for the legislation to meet the current challenges, while we are concerned certain provisions might not help in this regard and on the contrary create uncertainty for the operators. We attach a more detailed assessment of the Commission's proposal.

KWS calls for conventional treatment of genomic plant varieties

2 Nov 2023
Message — KWS requests that Category 1 plants follow the same rules as conventional ones. They advocate for allowing these innovative techniques in organic farming.12
Why — Standardizing rules would lower the financial and technical burdens of variety development.34
Impact — The organic sector loses access to improved plant varieties and modern breeding tools.5

KWS urges inclusion of carbon avoidance in EU certification

9 Mar 2023
Message — KWS proposes expanding the certification scheme to include carbon avoidance measures alongside carbon removal activities. They argue that high-performing seeds significantly reduce agricultural emissions through increased input efficiency.12
Why — Including avoidance would boost demand for KWS’s proprietary seeds and hybrid crop varieties.34
Impact — Early adopters of soil carbon practices may face a competitive disadvantage compared to others.5

KWS calls for pesticide ban exemptions for seed breeding sites

16 Sept 2022
Message — KWS requests a pesticide ban exemption for breeding and multiplication areas. They argue these chemicals are essential for developing healthy, resistant plants.12
Why — This exemption would protect their specialized breeding sites and prevent production losses.34
