Response to A new Circular Economy Action Plan

The LEGO Group is a family-owned, Denmark based company with production in Europe for the European markets. We support the European Commission’s ambition to accelerate the transition to a circular economy and drive the EU’s leadership globally. We are happy to share our input on the proposed long-term vision of what the future circular economy package should help deliver, and share some ideas on how best to get there. The future action plan should help mitigate uncertainties including consumer behaviour, global regulations, time to market of disruptive technologies, improved mechanical and chemical recycling, overall availability of quality sustainable materials, oil and materials prices, etc. while acknowledging that there are unknown unknowns. A European circular economy strategy should translate into globally applicable solutions that are science-driven, can be monitored and evaluated. Member States have a common approach to its implementation. Technology solutions support the transition to sustainable solutions. Open-source platforms are centrally accessible to build the knowledge-base and support research and industry efforts. The market for sustainable materials is competitive, of high quality and can meet demand at an affordable price. Downstream users have legal certainty that the finished materials are sustainable, receive incentives and operate in a predictable environment where they can define scenarios, plan and allocate resources. In addition to recycled content, reuse and repair, a future circular economy action plan should encourage the uptake of bio-based sustainable feedstocks versus oil-based solutions and support new business models to add to the mix of solutions. Bio-based solutions can advance the sustainable materials agenda and address the limitation that product safety legislation imposes on our ability to use recycled content. There is pressure to increase the usage of recycled content but there is no common, global approach to definitions, standards nor the legal framework that gives certainty of conforming to legislation. Traceability within the supply chain is important and needs to protect trade secrets in particular when companies have invested in new sustainable solutions. Governments also need to focus on infrastructure improvements that allow for the collection and processing of increased use of recycled materials. The legislative framework for product safety, chemicals, consumer protection and protection of the environment can conflict. It imposes a liability regime which can be a barrier to new business model that would seek to give a second life to products and keep them in play. Consumers are educated to make informed choices and their trust in sustainable, bio-based and recycled materials needs to be maintained given concerns over product safety.
